Elijah's appeal to dismiss divorce proceeding 'without prejudice'
According to TMZ, the filing on December 27 states that Elijah is "significantly incapable of handling his own financial affairs due to severe mental health and substance abuse issues."
A statement from her legal team mentioned that she "has been unable to discuss Elijah's preferences regarding the appointment of a temporary conservator, given Elijah's existing mental and physical health challenges."
The document also said, "urgently needed ... to protect Elijah’s property from loss or injury.”
The statement also outlines the reasons why conservatorship cannot be granted to his estranged wife Marieangela King, citing their tumultuous relationship characterized by a recurring cycle of drug addiction and mental health crises.
The filing states, "Elijah is entitled to regular distributions from the Trust, but given his ongoing mental health and substance abuse issues, [Cher] is concerned that any funds distributed to Elijah will be immediately spent on drugs, leaving Elijah with no assets to provide for himself and putting Elijah’s life at risk."
His attorneys said, "[He] is unable to form or express a preference concerning the appointment of a conservator for his estate."
Cher claims son is not fit to handle his finances
Cher said in October, quashing claims that she hired men to kidnap his son as per Elijahh’s wife King.
“I’m not suffering from any problem that millions of people in the United States aren’t,” she said on his son’s yearslong struggle with substance abuse.
“I’m a mother. This is my job — one way or another, to try to help my children. You do anything for your children. Whenever you can help them, you just do it because that’s what being a mother is."
She stated, "But it’s joy, even with heartache — mostly, when you think of your children, you just smile and you love them, and you try to be there for them.”
