LOS ANGELES, CALIFORNIA: The judge in Alec Baldwin's 'Rust' involuntary manslaughter case ruled to deny his motion to dismiss the indictment on Friday, May 24, per BBC

The judge rejected both of Baldwin's dismissal arguments regarding the grand jury process, concluding it wasn't prejudiced against him.

The defense had claimed that the prosecutors had broken the grand jury's rules in order to draw attention away from witnesses and exculpatory material. The prosecution has refuted this claim, branding the defense attorney "shameless" and highlighting inconsistencies in his remarks.

"We look forward to our day in court," Baldwin's lawyers Alex Spiro and Luke Nikas said in a statement  on Friday, May 24.

On January 19, Baldwin was charged with two felonies: involuntary manslaughter and negligent use of a handgun, or, alternatively, involuntary manslaughter without exercising reasonable caution or circumspection.

On October 21, 2021, cinematographer Halyna Hutchins, 42, was shot with a gun Baldwin was using during a rehearsal on the set of 'Rust', a Western being filmed in New Mexico.

The actor waived all of his pre-trial appearances and did not show up for the hearing on May 17.

His legal team made a virtual appearance, arguing that the prosecution had broken the law when the grand jury was being considered. Baldwin's lead attorney, Alex Spiro, concentrated on claims that the prosecution had not informed the witnesses prior to the grand jury.

"The way this is supposed to work is the grand jury's in a week, there’s all these witnesses that could come, you hit them with a subpoena, they come to the grand jury, or you have them on stand by, and you talk to them," Spiro said during the May 17 hearing. "This isn’t how you’re supposed to do it period."

Baldwin has submitted two more motions for dismissal. One for failing to allege a criminal act and one for destruction of evidence (relating to the handgun).

Internet wants Alec Baldwin's arrest

Several social media users voiced their opinion on Baldwin's case with a user writing, "It's not more complicated than that. The person responsible for a gun discharge and the ammo in it is the last person holding it regardless of industry or scenario."

Another user wrote, "Placing Alec in jail will send an incredibly large message that you can’t lie about your actions and get away with it."

A user said, "He is responsible at too many levels for dismissal! Send him to prison."

A user said, "Alec was careless with the handling of the gun. Other actors have been very responible with gun safety on movie sets. Alec needs to be held accountable for his actions!"

While a user said, "No one is above the law...."
