NEW YORK CITY, NEW YORK: Former president Donald J Trump has reportedly been barred from appearing on the ballots for the 2024 presidential primary elections in Colorado as a result of his role in the incitement of the January 6 Capitol riots.

The Colorado Supreme Court gave the 4-3 split decision on Tuesday, December 19, 2023. However, the ruling will not be taking effect until January 4, 2024, reported CNBC.

This delay gives Trump the window to appeal to the United States Supreme Court for an overturn of the judgment, effectively putting the Colorado decision on an indefinite hold from taking effect.

The 133-page ruling on the case read, "A majority of the court holds that President Trump is disqualified from holding the office of President under Section Three of the Fourteenth Amendment to the United States Constitution."

“Because he is disqualified, it would be a wrongful act under the Election Code for the Colorado Secretary of State to list him as a candidate on the presidential primary ballot," it further read.

“We do not reach these conclusions lightly," the statement continued. "We are mindful of the magnitude and weight of the questions now before us. We are likewise mindful of our solemn duty to apply the law, without fear or favor, and without being swayed by public reaction to the decisions that the law mandates we reach," the ruling stated.

“We are also cognizant that we travel in uncharted territory, and that this case presents several issues of first impression,” it added.

According to the BBC, this is the first instance where Section 3 of the US Constitution's 14th Amendment has been put to use to disqualify a presidential candidate. If the ruling stands, Trump will lose out on Colorado’s 10 votes in the Electoral College.

'The View' co-host rejoiced at the announcement and shared her take on social media.

Navarro's post on Instagram was accompanied by a long caption, "It should not take a Court ruling on the 14th Amendment to determine Donald Trump is disqualified to appear on the ballot."

Offering some choice words to the former president, she continued, "His lack of decency, unfitness of character, bigoted, racist language, moral and financial bankruptcy alone, should be disqualifying. But alas, that doesn’t seem to matter to most in the Republican base."

"And I have a hard time thinking the Conservative troglodytes on SCOTUS -and of course, regardless of conflicts, corrupt, unethical Thomas won’t recuse himself-, will find it disqualifying either," she added.

"But today, we celebrate," she announced, cheerfully concluding, "Hell, this even got me in the Christmas spirit! Ho! Ho! Ho!"
