The alleged incident happened late last year
According to court documents, the purported victim visited the 26-year-old's residence in New York City around 12:30 pm on December 29, 2023, purportedly to administer an at-home IV.
Basuljevic claimed to have observed "the presence of marijuana and drug paraphernalia" within the residence.
The nurse had to reportedly wait for 45 minutes before Declyn came and asked him “not to administer the IV” in his left arm.

Upon completing all routine checkups and procedures, when attempting "to insert the catheter," the behavior of the 70-year-old's son became erratic.
Basuljevic in his papers claimed that David Thornton’s son yelled at him and said, “[r]emove the IV, I don't want it in, it doesn't feel good, you don't know what the f**k you are doing, fishing around and s**t for my veins, what is this your first time doing this s**t.”
Declyn did not stop there as he allegedly “behaved[ed] in an erratic and aggressive manner” and “shouted at Plaintiff, '[y]ou tried to puncture to get into my veins, I m going to shoot you in your head, are you f**king crazy, you are f**king with my life.”

The plaintiff further claimed that the defendant threatened him, stating, "[i]f you do not leave right now I am going to f**king shoot you, I am going to grab my 9 and shoot you, you better leave now."
Basuljevic reportedly did not waste any time staying there as he was “terrified that Defendant was going to carry through on his threat.”
The alleged victim claimed in his suit that he was left with “severe emotional distress” and had to get help for "anxiety, fear, and depression,” which also harmed his professional life.
Basuljevic added that he was "unable to work for several months due to the debilitating fear and anxiety," while also demanding $2 million in punitive damages from Declyn.
