PALM BEACH, FLORIDA: Former President Donald Trump has criticized Special Counsel Jack Smith for his Tuesday court filing, which he perceives as "attacking" Judge Aileen Cannon.

This scathing condemnation from the 77-year-old MAGA figurehead comes months after he had launched similar diatribes on other judges overseeing his criminal and civil cases.

In a Truth Social post on Thursday, Trump called for Smith to be held accountable for criticizing the judge's request for jury instruction proposals in Trump's classified documents case.

Per NBC News, the presumptive 2024 Republican nominee asserted that such behavior is unacceptable and that Smith should be punished accordingly.

Trump blasts 'failure' Jack Smith on Truth Social

Trump wrote on Truth Social, “Deranged ‘Special’ Counsel Jack Smith, who has a long record of failure as a prosecutor, including a unanimous decision against him in the U.S. Supreme Court, should be sanctioned or censured for the way he is attacking a highly respected Judge, Aileen Cannon, who is presiding over his FAKE Documents Hoax case in Florida.”

“He is a lowlife who is nasty, rude, and condescending, and obviously trying to “play the ref.” He shouldn’t even be allowed to participate in this sham case, where I, unlike Crooked Joe Biden, Hillary Clinton, and all the rest, come under the Presidential Records Act,” the former POTUS remarked.



 

He concluded his post in all-caps, adding, “I DID NOTHING WRONG, BUT BIDEN DID, AND THEY LET HIM OFF SCOT-FREE. HOW DID THAT HAPPEN, JACK? A TWO TIERED SYSTEM OF JUSTICE. ELECTION INTERFERENCE!”

Special Counsel Jack Smith disputed Judge Aileen Cannon's order for conflicting jury instructions in a court filing on Tuesday, claiming that the request is founded on a “fundamentally flawed legal premise” that would “distort” the trial and perhaps result in a directed verdict for Trump.

Smith noted that federal prosecutors would file an appeal if the judge denied their request to "promptly" determine whether the legal presumption underlying her decision is a "correct formulation of the law."

Judge Cannon has issued an order to former President Donald Trump and Smith's office to submit two versions of proposed jury instructions relating to the Presidential Records Act in conjunction with the charges leveled against Trump under the Espionage Act, alleging that he mishandled classified documents.

The Presidential Records Act is a fundamental component of Trump's defense, which contends that the law authorizes him to determine whether documents are personal or presidential, and consequently, whether he may retain them after leaving office.

Special Counsel Jack Smith's office disputes this legal interpretation as unfounded.

The law requires presidential records to be archived, except for personal records, “such as diaries, journals, and medical records.”

One of the scenarios outlined in Cannon's order for jury instructions would permit the jury to review the records Trump retained and determine which of them are “personal” or “presidential” under the Presidential Records Act.

The second scenario requested lawyers to propose jury instructions based on the premise that presidents have the "sole authority" under that act to legitimately retain records when they leave office by designating them as “personal” or “presidential” records, echoing Trump's defense arguments in the case.

In its filing on Tuesday, Smith's office stated that Trump's assertion of the Presidential Records Act as a defense in the classified documents case is "not based on any facts."

“It is a post hoc justification that was concocted more than a year after he left the White House, and his invocation in this Court of the Presidential Records Act is not grounded in any decision he actually made during his presidency to designate as personal any of the records charged,” the prosecutors argued.

The ex-Commander-in-Chief is facing multiple charges for his alleged mishandling of classified documents following his term at the White House.

The charges include willful retention of national defense information, false statements and representations, and conspiracy to obstruct justice.

The defendant, Trump, has pleaded not guilty to the charges. In February, he requested that the case pertaining to the classified documents be dismissed, citing presidential immunity as his safeguard from prosecution.

Internet slams Trump for going off on Jack Smith on Truth Social

People on X lambasted the former POTUS calling for Special Counsel Smith's punishment for criticizing the legal premise in a request for jury instruction proposals by the judge in the classified documents case.
