WILMINGTON, DELAWARE: Federal prosecutors have levied accusations against Hunter Biden, the son of President Biden, alleging that he attempted to delay his upcoming trial for tax fraud through what they describe as a "stunt."

This comes as the younger Biden seeks to appeal the ruling denying his motion to dismiss the case, which accuses him of failing to pay over $1.4 million in federal income taxes between 2016 and 2019.

Appeal as a delay tactic

In court documents filed on Tuesday, May 7, prosecutors from special counsel David Weiss’ office asserted that Hunter Biden's filing of a notice of appeal was a deliberate ploy to postpone the trial set for June 20.

They argue that Biden's decision to ignore court schedules demonstrates an attempt to circumvent legal procedures.

"The defendant is simply choosing to ignore the Standing Order, without first seeking relief from this Court, while hoping that the Ninth Circuit will, contrary to its prior precedent, be the first court to find it has jurisdiction to consider the issues involved in his interlocutory appeal," stated Weiss. “An order is therefore needed from this Court to keep the pretrial schedule and deadlines on track for the trial scheduled for June 20, 2024.”

The prosecution further contended that even if the appeals court promptly rejects Biden's appeal, he may exploit the situation to request further delays under the pretext of needing more time for preparation.

“The court should reject the Defendant’s attempt to put himself above the law and game the system,” prosecutors wrote, urging a judge to ensure Biden honors all pretrial deadlines.

Defense's response

In response, Biden's defense team asserted that the prosecution's filing of an "ex parte application" caught them off guard, as they were not adequately informed or consulted beforehand.

“Although the Special Counsel did inform Mr. Biden’s counsel by email that it had a different interpretation of whether the Court’s Standing Order remains in effect while this case is on appeal, the Special Counsel never advised Mr. Biden’s counsel that it planned to file this ex parte application, nor asked Mr. Biden’s counsel’s position on the application, nor advised on an anticipated deadline to file an opposition,” the defense stated.

They criticized the prosecution for not providing prior notice or engaging in discussions regarding the matter, accusing them of violating court rules.

“Mr. Biden’s counsel twice requested a call to discuss the issue. Both times the Special Counsel refused, the last time stating only ‘in light of the position you’re taking we don’t think a call would accomplish anything,'” the defense added. “It is now clear that the prosecutors intended to file their motion and could easily have used Mr. Biden’s counsel’s request for a call to discuss the application, rather than invoke imaginary ‘extraordinary’ circumstances in seeking an ex parte application.”

Social media uproar

However, the first son received quite a backlash on social media for his alleged delay tactics.

"Entitled punk," one posted on X.

"Expect desperate tactics as Biden, Inc. is cornered," another wrote.

"He should have been arrested long ago!! #TwoTierJusticeSystem," someone else fumed.

"We need some action and accountability!!! If I or anyone else did this s**t we’d be in prison already," a comment read.

"Here’s the game, he appeals trial gets delayed, Biden loses and pardons his son. He never serves a day. Meanwhile, the rest of us little people pay the price," another offered.

Legal setbacks and charges

This latest development comes after a previous setback for Biden in the legal proceedings. On April 1, US District Judge Mark Scarsi rejected Biden's argument seeking dismissal of the charges, where he claimed to be a victim of "selective and vindictive" prosecution.

Biden's lawyer, Abbe Lowell, criticized the handling of the investigation by the special counsel's office, labeling it as "abnormal."

Biden faces a total of six misdemeanor and three felony counts in the tax case, with prosecutors alleging that he spent money on “drugs, escorts and girlfriends, luxury hotels and rental properties, exotic cars, clothing, and other items of a personal nature, in short, everything but his taxes.”

Additionally, he faces separate charges in Delaware related to illegal possession of a firearm while addicted to drugs, with that trial scheduled for June 3, the New York Post reported.
