WASHINGTON, DC: Hunter Biden attempted to have the gun charges against him dropped, but a federal judge in Delaware refused his request on Friday, April 12. The judge rejected the first son's argument that the prosecution was politically motivated, according to the New York Post.

In December 2023, Hunter Biden's lawyers requested that US District Judge Maryellen Noreika dismiss his felony weapon possession charge and the two associated false statement counts that special counsel David Weiss had brought.

The first son's lawyers said that since special counsel 'buckled under political pressure' from former President Donald Trump and congressional Republicans, the case against their client is a 'selective and vindictive prosecution' and 'a breach of separation of powers'.

Notably, Noreika dismissed Hunter Biden's allegation as 'nonsensical', saying the argument was not persuasive. In her 26-page ruling, she wrote, "To the extent that Defendant’s claim that he is being selectively prosecuted rests solely on him being the son of the sitting President, that claim is belied by the facts."

Moreover, the judge pointed out that Attorney General Merrick Garland, who appointed Weiss as special counsel, was nominated by and answers to Joe Biden, and that it was the Biden Justice Department that finally pursued charges against Hunter.

Noreika wrote, "Defendant’s claim is effectively that his own father targeted him for being his son, a claim that is nonsensical under the facts here."

She added, "Regardless of whether Congressional Republicans attempted to influence the Executive Branch, there is no evidence that they were successful in doing so and, in any event, the Executive Branch prosecuting Defendant was at all relevant times (and still is) headed by Defendant’s father."

Furthermore, two more motions submitted by Hunter Biden's legal team were turned down by Noreika, who was nominated to the bench by Trump.

A motion was made claiming that the prosecution of Hunter Biden was against a diversion arrangement that had been sabotaged by the first son and the administration. A rejected plea deal with federal prosecutors included the agreement. The other motion contested Weiss' appointment as special counsel's legality.

Notably, in the gun case, Hunter Biden has entered a not-guilty plea to each of the three allegations. He has acknowledged being addicted to crack cocaine, and it is alleged that he lied about his drug usage on federal paperwork when he purchased a Colt Cobra 38SPL revolver in October 2018.
