WASHINGTON, DC: President Joe Biden denounced US District Judge Aileen Cannon's dismissal of the classified documents case against Donald Trump but stated he was "not surprised."

In an interview with NBC News' Lester Holt on Monday, July 15, the octogenarian stated that US Supreme Court Justice Clarence Thomas' opinion in the presidential immunity ruling influenced Cannon's decision to dismiss the criminal charges against his predecessor.

"I'm not surprised. It comes from the immunity decision the Supreme Court ruled on," Biden said.

Earlier this month, the conservative Supreme Court ruled that presidents have "absolute immunity" for actions taken under "core constitutional powers" and "presumptive immunity" for other official acts.

This decision shielded Trump from criminal prosecution related to his actions within the scope of constitutional powers.

Joe Biden disagrees with Clarence Thomas' opinion and Aileen Cannon's decision on Donald Trump's case

Notably, the SCOTUS immunity ruling did not cause Cannon to dismiss the classified documents case in Florida.

In a concurring opinion following the Supreme Court's ruling in favor of the real estate mogul, Thomas raised concerns about the legitimacy of special counsel Jack Smith's appointment to investigate the case.

According to him, it violated the "constitutional structure" because Smith's office was not established by law. The conservative justice opined the prosecution could only proceed after answering those questions.

On Monday, July 15, the federal judge agreed with the defense attorneys' assertion that Smith was improperly appointed, leading to the dismissal of all charges against Trump.

Before his appointment as a special counsel under Biden's Justice Department, Smith was a leading prosecutor for the International Criminal Court in The Hague.

Besides the classified documents case, he brought another indictment in Washington, DC, over Trump's alleged attempt to overturn the 2020 election results.

"Clarence Thomas, in his dissent, said that independent prosecutors appointed by the Attorney General aren't legit. That's the basis in which this judge moved to dismiss," Biden told Holt, disagreeing with the justice.

Biden referenced the classified documents investigation involving himself to support his position. He stated that prosecutors examined all his belongings for months and that he was fully cooperative.

"That's appropriate. And they looked at me and concluded I didn't do a damn thing wrong," Biden added.

In February, former special counsel Robert Hur found that Biden wilfully retained classified documents during his vice presidency but did not press charges, describing him as an "elderly man with poor memory."

Regarding the Cannon's dismissal of the case against Trump, the octogenarian said that the "basis upon which the case was thrown out" was "specious."

"I don't agree with Clarence Thomas's dissent and nor the Supreme Court decision on immunity," he stated.

Joe Biden's criticism of Trump-appointed Judge Aileen Cannon's decision to dismiss the classified documents case against the ex-president backfired on social media. Netizens disagreed with his stance, arguing it was unrelated to the immunity ruling.

"Biden has no respect for the courts unless they agree with him . He has no problem undermining the third branch of government and the legitimacy of checks and balances," a user said. [sic]

"He has no choice but to criticize this. It was the last chance to actually put Trump in legal jeopardy, before the election. Now he has no chance," another remarked.



 



 

"As usual, Biden is confused. This decision had nothing to do with the SCOTUS decision on immunity. It was solely because Smith was improperly appointed. Biden is clueless, or he is lying," one user commented on Facebook.

"Let's be honest Biden's opinion in his present state is of no value. The judge ruled as the constitution states. Jack Smith was illegally appointed," someone else argued.

"Ashley SmithHe just insulted an intelligent female judge ….   great job Joe …. No wonder why they try to keep you in the basement," another chimed in. [sic]
