CARSON CITY, NEVADA: Independent presidential candidate, Robert F Kennedy Jr's bid in Nevada, hit a snag when two voters filed a lawsuit to disqualify him from the Silver State ballots, alleging he violated the state's legal criteria for independent candidates.

Uwe Rockenfeller and Francisco Morales filed the lawsuit on Thursday, June 20, naming Kennedy and his vice presidential pick Nicole Shanahan and Nevada Secretary of State Francisco Aguilar as defendants. Morales is a vice-chair of the Nevada Democratic Party. At the same time, Rockenfeller, who is a registered Republican, had exclusively donated $42,500 in the past six years to Democratic candidates, as per the New York Post.

Lawsuit claims RFK Jr is not an independent candidate under Nevada law

According to plaintiffs, Kennedy "claims that he is an 'Independent' candidate for President of the United States while simultaneously seeking the nominations of at least six separate political parties in six other states" after he exited the Democratic primary race against President Joe Biden.

The lawsuit noted that the parties "have distinct platforms and ideologies," like the American Independent Party of California "has a sordid history, supporting past segregationist candidates for president like former Alabama governor George Wallace."

Besides the AIP, the environmental lawyer is running as a candidate for the We the People Party in Hawaii and North Carolina, the third party he founded, the Natural Law Party in Michigan, and the Reform Party in Florida.

In addition to his multiple party affiliations, Kennedy violated another state requirement as he allegedly filed the qualifying petition without naming a vice presidential mate and sued against the issue instead of correcting it.

An independent candidate is someone "who is registered with no political party affiliation," and "a person may not file as an independent candidate if he or she is proposing to run as the candidate of a political party," as per Nevada law.

The plaintiffs Morales and Rockenfeller argued that Kenndey and Shanahan were aiming "to game their way onto Nevada's ballot in order to play spoiler after the Democratic Party rejected his candidacy."

Removing the independent's name from the ballot could be decisive in the outcome in the swing state.

In 2016, Hillary Clinton defeated former President Donald Trump by 27, 202 votes; in 2020, he lost to Biden by 33, 596 votes. However, the latest poll by FiveThirtyEight showed that Trump had a 2.8 per cent lead over Biden, whereas Kennedy possessed 9.4 per cent of the votes that could impact the neck-to-neck race.

Internet blasts Democratic Party over lawsuit against RFK Jr in Nevada

Internet users slammed the Democratic Party as a new lawsuit claimed Kennedy was not eligible as an independent presidential candidate in Nevada.

"Protectors of democracy doing every undemocratic thing to protect democracy," a user said.

Another remarked, "then maybe they shouldn't have given him the Bernie Sanders treatment. they have no one else to blame but themselves."

A third user added, "They obviously want joe to be the only one running in 2024."

A fourth response read, "He should have been their candidate. Shameful."

"Imagine feeling so threatened by RFK Jr that’s what happens when you have no policies that are good and your entire party is just catch phrases and made up platitudes," another person wrote.

Someone else claimed, "Usually in a fair election all candidates get to decide if they’ll run or not, rather than a party of one candidate deciding. From conspiracy to lawsuits, there’s nothing Democratic operatives won’t try. They know they’re going to lose WH + Senate + House and it won’t be close."

An individual wrote, "One thing democrats really hate is democracy. They cheat and try to foil it at every turn."

"Politics has become so shady. This is a dirty way to eliminate your competition..." another user chimed in.
