Fact Check: Will Democrats pass the Alex Pretti Act ending ICE agents’ immunity?

WASHINGTON, DC: Democrats are allegedly planning to pass the 'Alex Pretti Act' to end qualified immunity for ICE agents if they win the 2026 midterms, according to statements from 16 anonymous House and Senate members.

The proposed legislation follows the fatal shooting of 37-year-old ICU nurse Alex Pretti by Border Patrol agents in Minneapolis on January 24, 2026, during an immigration enforcement operation. The incident, coming just weeks after a similar shooting of Renee Good, sparked nationwide protests and renewed calls for accountability.

Claim: Democrats to pass a bill called the Alex Pretti Act



According to a post shared by PoliticsVideoChannel (@politvidchannel) on X, Democrats reportedly plan to pass a bill if they win the 2026 midterm elections.

The elections, scheduled for November 3, 2026, occur midway through President Donald Trump’s second nonconsecutive term and serve as a major national referendum, with control of both chambers of Congress at stake.

The X post stated, "BREAKING EXCLUSIVE: If Democrats win the 2026 midterms, they plan to pass a bill called the Alex Pretti Act that will end qualified immunity for ICE agents, allowing them to be sued or jailed for wrongdoing."

The same X account followed up, reporting, "Sources tell us that 16 House and Senate members have confirmed—if Democrats win the 2026 midterms and regain control, they plan to introduce and pass the 'Alex Pretti Act.' This bill would end qualified immunity for ICE agents, opening the door for them to be sued or jailed for wrongdoing on the job."

Another post added that the proposed Alex Pretti Act builds on previous efforts to remove qualified immunity for ICE agents.

The post added, "In October 2025, Rep. Shri Thanedar (D-MI) introduced a bill to end QI for ICE agents, arguing no one should be above the law. More recently, Reps. Eric Swalwell and Dan Goldman proposed similar legislation in January 2026."

Fact Check: No evidence shows that the Alex Pretti Act exists

While several X users and others on social media have claimed that Democrats are planning to pass an “Alex Pretti Act,” the claim is false. Democrats have introduced multiple bills aimed at limiting qualified immunity for ICE and CBP officers following high-profile incidents, but no legislation specifically named the Alex Pretti Act appears in current congressional records. 

The viral posts combine real events, existing legislation, and Democratic priorities with unverified “exclusive” sourcing and a bill name that does not exist as described. Democrats have introduced or proposed bills to restrict or end qualified immunity for ICE and CBP agents, particularly in response to recent controversial enforcement incidents.

One such bill is Rep Shri Thanedar (D-MI), who introduced the Ending Qualified Immunity for ICE Agents Act (H.R. 4944) in 2025. Reps Dan Goldman, Eric Swalwell, and others proposed similar measures in early 2026, such as the ICE OUT Act

Other legislation, including Rep Haley Stevens’ Hold ICE Accountable Act and Rep Julie Johnson’s Qualified Immunity Accountability Act, also targets accountability for ICE misconduct. 

There is no evidence that an “Alex Pretti Act” exists. Congressional records and credible reporting do not show a bill by this name being introduced or planned. The name appears only in viral social media posts and should be treated as a rumor rather than confirmed legislation. Additionally, claims citing “16 anonymous House and Senate members” are unverified. No named lawmakers or public statements support a coordinated plan tied to this bill or the 2026 midterms, and the anonymous sourcing makes verification impossible.
