LOS ANGELES, CALIFORNIA: California federal judge Mark Scarsi is reportedly considering imposing sanctions on Hunter Biden’s legal team.

The judge accused the lawyers of fabricating statements in their attempt to leverage a recent dismissal in Donald Trump’s case to dismiss Biden’s tax case.

Judge Mark Scarsi highlights false statements and legal distinctions

Judge Mark Scarsi criticized Biden's defense attorney for making false claims in court documents. The attorney falsely claimed multiple times that special counsel David Weiss did not file charges against Hunter Biden until he was appointed as a special prosecutor.

Judge Scarsi highlighted that these lies were substantial because Weiss was already prosecuting Biden in his capacity as the US attorney-client for Delaware before receiving the special prosecutor title.

This situation differs significantly from Donald Trump’s case, where special counsel Jack Smith was appointed specifically to prosecute Trump before any charges were filed.



 

The distinction between the two cases lies in their procedural histories. Weiss was initially appointed by a Senate vote before being elevated to special counsel, whereas Smith was appointed directly by Attorney General Merrick Garland without Congressional approval.

Judge Scarsi pointed out that Hunter Biden's legal team failed to acknowledge this critical difference. “But Mr Biden’s motion does not engage with this distinction; instead, counsel avoids the issue by misrepresenting the history of the proceedings,” Scarsi wrote. “This court has little tolerance for lack of candor from counsel.”

Donald Trump's case and its repercussions

The backdrop to Biden's legal maneuvers is the recent decision in Trump’s case. Criminal charges against Trump in Florida, related to his alleged mishandling of confidential documents at Mar-a-Lago, were dismissed. The dismissal was based on the argument that Jack Smith's appointment was unlawful because it lacked Congressional approval.

Smith’s office has since appealed this non-final decision.



 

Three days after the ruling in Trump’s case, Hunter Biden's lawyers, Abbe Lowell and Bartholomew Dalton, filed a motion to dismiss Biden’s tax evasion case on similar grounds.

However, Judge Scarsi is now threatening monetary sanctions against them for these actions. He has given Biden's attorneys an opportunity to respond satisfactorily to his findings or to amend the motion papers containing the false statements.

Mark Geragos, another attorney representing Biden, defended the motion, asserting that the primary issue is whether the US attorney in Delaware had the authority to bring charges in California. Geragos stated that Hunter Biden’s legal team plans to address Judge Scarsi’s concerns thoroughly in upcoming court documents.

Hunter Biden, 54, is facing a trial in September for allegedly evading taxes on $1.4 million in income over three years. Additionally, he was convicted in Delaware for illegally owning a firearm while addicted to crack cocaine, a charge that could result in up to 25 years in prison, the New York Post reported.

Hunter Biden and his legal team mocked on social media

Hunter and his lawyers were trolled on social media after being threatened with sanctions for lying in court papers.

"Birds of a feather," one posted on X.

"What a disgrace," a second user wrote.

"Abbe Lowell's days leeching off Hunter are almost over," another quipped.

"Wonder what Hunter will do now with his father stepping down, and his money connections to be severed," read a comment.

"Who is paying Hunter's legal bills? They must be astronomical, and Hunter does not even have a job," someone else chimed in.

Hunter Biden's lawsuit against Fox News

This comes as Hunter Biden recently dropped his lawsuit against Fox News. The suit concerned the network airing explicit images from his personal laptop, which were featured in a six-part series on Fox Nation in 2022. The series included a mock trial focusing on Biden’s foreign business dealings and portrayed him using crack cocaine and engaging with prostitutes.

Fox News removed the series after Biden threatened legal action, citing caution. However, the network maintained its position, defending its coverage and arguing that Biden, as a public figure and convicted felon, was subject to First Amendment protections.

“Consistent with the First Amendment, Fox News has accurately covered the newsworthy events of Mr. Biden’s own making,” the network said in a statement at the time.



 

Biden’s legal team had attempted to sue under New York state’s revenge porn statutes, which prohibit the distribution of sexually explicit material without consent if it causes harassment or distress. Nonetheless, the lawsuit's challenges included Biden’s public prominence and the network’s consistent reminders that the trial was not real, NPR reported.
