Federal court denies Hunter Biden's request to dismiss gun charges 'for lack of appellate jurisdiction'
GREENVILLE, DELAWARE: Hunter Biden's legal team urged the federal appeals court to dismiss the gun charges he faces next month, but the request was denied.
Biden, on the basis of the Second Amendment, had appealed a pretrial order to dismiss the charges. However, the appeal was dismissed by the United States Court of Appeals for the Third Circuit. "The defendant’s Second Amendment defense does not implicate a right not to be tried that can be collaterally appealed," the court stated, as per Fox News.
The court stated that the hypothetical Second Amendment defenses "can be effectively reviewed on appeal after final judgment." "The defendant's interlocutory appeal is therefore dismissed for lack of appellate jurisdiction," the document states.
What charges does Hunter Biden face?
The first son is charged with making false statements on a federal form when purchasing a firearm in 2018 after Special Counsel David Weiss charged him with making a false statement in the purchase of a firearm; making a false statement related to information required to be kept by a licensed firearm dealer; and one count of possession of a firearm by a person who is an unlawful user of or addicted to a controlled substance.
Hunter Biden pleaded not guilty to the federal gun charges in the US District Court for Delaware. The court in Hunter Biden's case met for its final hearing before jury selection begins on June 3.

According to a source with knowledge of the October 23, 2018 incident, Hallie, who was dating Hunter at that time, threw the 54-year-old's gun into a dumpster behind a market close to a school. She is likely to be required to testify in the upcoming trial.
A reporter for NBC News was met with harsh criticism for pointing out her connection to the trial on social media. Biden's allies maintained that the visit was appropriate.
