GREENVILLE, DELAWARE: Hunter Biden's legal team urged the federal appeals court to dismiss the gun charges he faces next month, but the request was denied.

Biden, on the basis of the Second Amendment, had appealed a pretrial order to dismiss the charges. However, the appeal was dismissed by the United States Court of Appeals for the Third Circuit. "The defendant’s Second Amendment defense does not implicate a right not to be tried that can be collaterally appealed," the court stated, as per Fox News

The court stated that the hypothetical Second Amendment defenses "can be effectively reviewed on appeal after final judgment." "The defendant's interlocutory appeal is therefore dismissed for lack of appellate jurisdiction," the document states.

According to a source with knowledge of the October 23, 2018 incident, Hallie, who was dating Hunter at that time, threw the 54-year-old's gun into a dumpster behind a market close to a school. She is likely to be required to testify in the upcoming trial.

A reporter for NBC News was met with harsh criticism for pointing out her connection to the trial on social media. Biden's allies maintained that the visit was appropriate.
