Internet weighs in as FBI informant accused of fabricating $10M bribery allegation against Bidens rearrested under ‘bizarre circumstances’

LAS VEGAS, NEVADA: Alexander Smirnov, a former FBI informant accused by Special Counsel David Weiss of manufacturing a $10 million bribery allegation against President Joe Biden and First Son Hunter Biden, was rearrested on Thursday, February 22, under what his lawyers described as “bizarre circumstances". This comes just two days after his release from jail, per the New York Post.

According to court documents, Smirnov, 43, was taken into custody at the downtown Las Vegas law offices of his attorneys, David Chesnoff and Richard Schonfeld, while consulting with them on his case.

What prompted authorities to rearrest Smirnov?

On Tuesday, February 20, US Magistrate Judge Daniel Albregts granted pretrial release to Smirnov, who is a dual US-Israeli citizen, under certain conditions.

The Justice Department had attempted to keep him in custody, but their request was denied.

However, the government has now filed a motion to reopen Smirnov's detention hearing in the Central District of California, where he was indicted by a federal grand jury earlier this month on charges of making a false statement and creating a false and fictitious record.



 

“Despite Judge Albregts’s prior ruling, denial of the stay request, and Mr Smirnov’s prior release from custody, on the morning of February 22, 2024, Mr Smirnov was arrested for a second time – on the same charges and based on the same indictment … while at the undersigned counsel’s law office for meetings with counsel,” Smirnov’s attorneys wrote in a motion for emergency detention hearing in the US District Court for the District of Nevada. 

“It should further be noted that the fact that [Smirnov] was attending a legal consultation meeting at his attorneys’ office contradicts the notion that he is a risk of flight,” they stated.

Chesnoff and Schonfeld asserted that the rearrest violated their client's Sixth Amendment rights.

“There are no provisions for the rearrest of Mr Smirnov in this District after being ordered released,” the lawyers posited, noting that the new arrest warrant came from the Central District of California.

Smirnov's motion argues that the Nevada court hold his "second initial appearance" and release him "without unnecessary delay," highlighting the "bizarre circumstances" of his rearrest.

On the other hand, Smirnov's attorneys requested that the US Marshals Service hold him in Nevada until after a new detention hearing and that an "emergency hearing" be held before the chief judge of the Nevada court.

Internet says there are no chances of Smirnov’s acquittal
