California State Bar recommends disbarment for ex-Trump lawyer John Eastman over 2020 election role
SAN FRANSISCO, CALIFORNIA: The California State Bar recommended disbarring former Trump lawyer John Eastman over his attempts to overturn the 2020 election results supporting ex-president Donald Trump's false claims, reported ABC News.
In January 2023, the State Bar charged the ex-Trump attorney with multiple disciplinary counts based on accusations that he engaged in "a course of conduct to plan, promote, and assist then-President Trump in executing a strategy, unsupported by facts or law, to overturn the legitimate results of the 2020 presidential election."
The filing by State Bar Court Judge Yvette D Roland on Wednesday, March 27, said, "Eastman's wrongdoing was committed directly in the course and scope of his representation of President Trump and the Trump Campaign."
Stating his actions after the 2020 election "transgressed those ethical limits by advocating, participating in and pursuing a strategy to challenge the results of the 2020 presidential election that lacked evidentiary or legal support," she added, "In view of the circumstances surrounding Eastman's misconduct and balancing the aggravation and mitigation, the court recommends that Eastman be disbarred."
According to CNN, the attorney's license to practice law will cease within days because the court's recommendation would involuntarily cancel it.
Judge criticized John Eastman's lack of guilt
In her filing, Judge Roland also called out Eastman's lack of remorse and denial of admitting ethical lapses in the matter.
She wrote the former Trump attorney displayed an "unwillingness to acknowledge ethical lapses regarding his actions, demonstrating an apparent inability to accept responsibility," and his lack of guilt "presents a significant risk that Eastman may engage in further unethical conduct, compounding the threat to the public."
Investigators for the California bar claimed that the memos Eastman drafted included "demonstrably false and misleading statements" that were later used in "legal strategies" to have then-Vice President Mike Pence interfere in the certification of the 2020 election that President Joe Biden won.
The disbarment process that started in June 2023 included testimony from Greg Jacob, Pence's legal counsel, state election officials across different states, and two experts whom the ex-Trump lawyer sought help for his false election fraud claims.
Eastman is also a co-defendant in the indictment against Trump brought by special counsel Jack Smith and the criminal election subversion case in Georgia.
In a statement to ABC News, Eastman's lawyer, Randall Miller, denied the California State Bar's recommendation. "The process undertaken by Dr. Eastman in 2020 is the same process taken by lawyers every day and everywhere -- indeed, that is the essence of what lawyers do. To the extent today's decision curtails that principle, we are confident the Review Court will swiftly provide a remedy," he said.
