AUSTIN, TEXAS: The Supreme Court of Texas rejected a challenge to the state's strictest abortion ban in response to a 2023 lawsuit filed by a group of women who underwent severe complications in their pregnancies, reported NBC News.

The nine justices of the conservative apex court, all Republicans, unanimously ruled against the lawsuit on Friday, May 31.

The case Zurawski v Texas stemmed from the lawsuit brought by five women in March 2023 because they were denied an abortion despite pregnancy complications that endangered their lives. Later, the case grew to 20 women and two doctors.

The lawsuit aimed to compel the Supreme Court to clarify and make transparent the precise circumstances that allowed for exemptions to restrictive abortion access, without overturning the ban itself.

In addition, the plaintiffs intended to get more discretionary freedom for doctors to intervene in case of pregnancy complications.

Texas Supreme Court offers a sliver of clarity on abortion ban

The conservative Texas Supreme Court offered limited clarification on the abortion law. The ruling provided an exception for undergoing an abortion in cases of preterm premature rupture of membranes, which involves the breakage of the amniotic sac before 37 weeks of pregnancy, due to the risk of infection.

However, the verdict emphasized that the state law "clearly does not allow abortion solely based on a diagnosis of an abnormal condition in the unborn child, even if it is life-limiting."

Additionally, it stated, "The law does not permit abortions for diagnosed fetal conditions unless there is a life-threatening complication for the mother, which does not make it unconstitutional," as reported by NBC News Channel 4 San Antonio.

The Lone Star state's abortion laws are among the strictest, prohibiting all abortions with the only exception to save the mother's life. A doctor breaking the law could lose a medical license along with up to 99 years of imprisonment for a minimum $100,000 fine.

The Supreme Court also disagreed with a lower court ruling that brought a temporary injection in stopping the state from enforcing the ban against doctors who conducted abortions due to complications endangering the mothers' lives.

The lead plaintiff, Amanda Zurawski, expressed outrage at the Friday ruling.

“It’s pretty heartbreaking that the Texas Supreme Court made it very clear today that they do not wish to help pregnant Texans. They don’t wish to clarify things for doctors in the state of Texas,” she said.

“They had an opportunity to make things better, and they didn’t. So as a result, people are going to continue to suffer," added Zurawski, who faced a life-threatening situation in August 2022 when doctors delayed her crucial abortion despite severe complications during her 18th week of pregnancy.

Zurawski v Texas case was the first one to legally challenge the abortion ban, mainly focused on females with pregnancy complications.

Abortion is one of the hot topics in the 2024 presidential rematch between Joe Biden and Donald Trump in a post-Roe v Wade America.

Internet enraged at Texas Supreme Court's rejection of lawsuit challenging abortion ban

Netizens lashed out at the Texas Supreme Court's unanimous decision to deny the lawsuit seeking more clarity to exempt the abortion ban.

A user wrote, "This is a travesty of justice and a display of fallacious logic. The law is the problem, if there had been no law these women would not have had these issues."

"The Texas Supreme Court doesn’t care about the truth, only about punishing pregnancy capable people," another fumed. 



 



 

A user argued, "Women are no longer being considered people or people whose lives matter… thus is so wrong!"

Meanwhile, another user opined, "States with these repressive laws also experience a lower number of medical residents in training. If you can't practice medicine due to the laws- you will go elsewhere."

Another enraged person wrote, "Pure unadulterated garbage Texas court."

"The Texas Supreme Court is horrific and dangerous when it comes to making decisions for women's health care," an individual fumed.
