Trump admin wins court ruling lifting limits on ICE tactics against Minnesota protesters
MINNEAPOLIS, MINNESOTA: The Trump administration secured a legal victory on January 26 after a federal appeals court temporarily lifted restrictions that had barred federal immigration agents from using certain enforcement tactics against protesters in Minnesota.
The decision allows Immigration and Customs Enforcement (ICE) greater operational latitude amid ongoing demonstrations and legal disputes.
The ruling by a three-judge panel of the 8th US Circuit Court of Appeals stayed a lower court order that had prevented officers from arresting, detaining, pepper-spraying, or retaliating against protesters in Minneapolis without probable cause, as anti-ICE agitators continue to confront authorities conducting enforcement operations.
Appeals court restores ICE enforcement powers
In a January 16 ruling, District Judge Kate Menendez sided with protesters and issued a preliminary injunction.
The lawsuit alleged that federal authorities violated the civil rights of six protesters. The plaintiffs sued the Department of Homeland Security and Immigration and Customs Enforcement over their treatment during immigration enforcement operations.
In her ruling, Menendez found that the plaintiffs were likely to succeed on claims that federal agents violated their First and Fourth Amendment rights during protests and while observing ICE activity tied to Operation Metro Surge in the Twin Cities.
That decision was overturned by a ruling from a three-judge panel of the 8th US Circuit Court of Appeals. “We accessed and viewed the same videos the district court did,” the appeals court said in its ruling.

The Eighth Circuit agreed to stay the lower court’s order, allowing federal agents to resume enforcement tactics previously limited by the injunction while litigation continues.

Following a wave of immigration raids, ICE, Border Patrol, and DHS agents flooded Minneapolis and other areas, triggering protests.
Critics of the crackdown say federal agents are being overly aggressive and creating chaos. Supporters, however, argue the government is simply enforcing immigration laws.
The legal battle intensified after high-profile incidents, including the fatal shooting of Minneapolis resident Alex Pretti by a Border Patrol agent during an operation, which sparked public outrage and calls for transparency.
