Alina Habba says 'justices made the right decision' as she hails SC's ruling that could protect Donald Trump from criminal prosecution

WASHINGTON, DC: A significant Supreme Court decision on Monday, July 1, was welcomed by the former president Donald Trump's reelection campaign that may provide the 2024 candidate with considerable protection from criminal prosecution

The Supreme Court held that a former president is shielded from prosecution for official acts performed while in office in Trump v United States, but not for unofficial acts, Fox News reports. 

The Court sent the matter back to a lower court

The Court returned the case to a lower court with a six-three decision, not applying the ruling to the question of whether former President Trump is exempt from prosecution with regard to actions connected to efforts to void the 2020 election results.

Donald Trump's 2024 Senior Adviser Alina Habba says 'the justices made the right decision'

"I think that the Justices made the right decision," Trump 2024 Senior Adviser Alina Habba said during an appearance on 'America's Newsroom.' "Nixon V Fitzgerald outlined this. Absolute immunity is important for all presidents. I've said it time and time again. I've argued on immunity for President Trump and I think they did get right that they recognize absolute immunity exists," she continued.

According to Habba, the Supreme Court's recognition of the constitutional rights of presidents and the executive branch is "a good day" but she emphasized that Trump never should have been in a position that would result in such a decision. "This is a disgrace to America," she said.

Alina Habba thinks the decision would slow down Jack Smith's 'persecution' and 'prosecution' of Donald Trump

Habba further conjectured that Jack Smith's "persecution and selective prosecution" of the former president would be slowed down by the decision. "I don't see how this case could go forward before the election," Habba added.

What did Chief Justice John Roberts say on the SC ruling?

"The President enjoys no immunity for his unofficial acts, and not everything the President does is official," Chief Justice John Roberts wrote for the majority. 

"The President is not above the law. But Congress may not criminalize the President's conduct in carrying out the responsibilities of the Executive Branch under the Constitution. And the system of separated powers designed by the Framers has always demanded an energetic, independent Executive," he said.

"The President, therefore, may not be prosecuted for exercising his core constitutional powers, and he is entitled, at a minimum, to a presumptive immunity from prosecution for all his official acts. That immunity applies equally to all occupants of the Oval Office, regardless of politics, policy, or party," he continued.

Donald Trump said the decision 'is a big win for our Constitution and for democracy'

In an exclusive interview with Fox News, former President Trump said, "I have been harassed by the Democrat Party, Joe Biden, Obama and their thugs, fascists and communists for years, and now the courts have spoken."

"This is a big win for our Constitution and for democracy. Now I am free to campaign like anyone else. We are leading in every poll—by a lot—and we will make America great again," he added.

Internet thinks the CNN debate affected the SC ruling

Netizens reacted after the Trump campaign welcomed the Supreme Court decision. One X user wrote, "Debate between Trump and Biden affected the Supreme Court ruling," whie another tweeted, "Biden should be overjoyed, otherwise the next DOJ could prosecute him for treason resulting from failing his sworn duty to protect our country from illegal entry."  



 



 

"Just in time to protect the next former President," opined one while another remarked, "So now Biden is above all laws too. Thanks Republicans!" "Trump will win in a landslide ! Time for the criminal Biden’s to go to jail. Really time for America to get busy fixing the real problems !" said someone else.
