Brandon Rasberry: Texas boy, 10, who admitted to killing man 2 years ago faces no charges under state law

NIXON, TEXAS: A 10-year-old boy from South Texas admitted to authorities that he fatally shot a man two years ago. But he will not be charged for the crime.
Brandon O’Quinn Rasberry, 32, tragically lost his life in Nixon, Texas, on January 18, 2022, as a result of the boy's actions.
Insights into tragic shooting
According to reports from the Gonzales County Sheriff’s Office, the unidentified child disclosed first-hand information about the shooting death of Rasberry while being questioned for allegedly threatening a classmate.
The child recounted how he took a pistol from his grandfather’s truck, entered Rasberry’s recreational vehicle (RV) at an RV park, and fatally shot him on January 18, 2022, in Nixon, Texas, approximately one hour east of San Antonio.
Despite the shocking nature of the confession, state law prevents the child from being charged in connection with the 2022 homicide due to his age at the time of the crime, as cited by the Texas Penal Code.
At the time of the murder, the child was seven years old, one week away from his 8th birthday.
Child's lack of motive and discovery of murder weapon
The child informed investigators that he had never encountered Rasberry previously but had observed him walking around the RV earlier that day.
“The child was also asked if he was mad at Brandon for some reason or if Brandon had ever done anything to him to make him mad, the child stated no,” the release stated.
Investigators discovered the firearm used in Rasberry’s homicide at a pawn shop in a neighboring town on April 12, later confirming that the shell casings found at the crime scene matched those from the weapon.
The child informed investigators that the gun had been pawned by his grandfather.
Jonathan Fojtik, Rasberry’s brother, expressed his disbelief and sorrow upon learning of the circumstances surrounding his brother's death.
"Finding out it was a 7-year-old that committed the murder, a senseless murder at that, it’s just tragic. It’s kind of hard to wrap your head around," Fojtik lamented. “Brandon was a loving person. He’d give the shirt off his back for anyone.”
The child faces charges related to the threat made against his classmate and is currently in juvenile detention awaiting a court date.
