SPRING, TEXAS: Carey Birmingham, a 60-year-old Texas man, has been sentenced to 10 years in prison for the fatal shooting of his wife, Patricia, following the discovery of her alleged affair.

The shocking incident unfolded outside their Spring, Texas home in December 2021, captured on camera as Birmingham uttered the chilling words, "I hope it was worth it. I'm done, I'm f–king done."

Defense attempts to portray shooting as spontaneous act

The court heard that the couple engaged in a heated 30-minute argument before Birmingham took the drastic step of shooting his wife three times. The motive, allegedly rooted in suspicions of infidelity, further deepened the tragic nature of the crime.

Birmingham's legal defense, led by Anthony Osso, opted for a rare strategy—pleading guilty directly to an all-women jury. Osso aimed to convey that the shooting was a result of a spontaneous outburst rather than premeditation.

“We never tried to justify the actions of our client, but the defense wasn’t about justification. It was about why he did what he did,” said Osso, reported ABC.

Daughter says she lost both parents on same day

Despite Osso's efforts, Birmingham's daughter, Olivia, remains skeptical of the defense's claim that the crime was a result of “sudden passion." “You have to have something. You have to have made that decision within you for a while; I feel like to do something, to do that to someone you really love,” she said. 

“No matter what was said in this trial, you know what type of woman she was, and you know what you did and how he took away my favorite person in this world.” For Olivia, the tragedy extends beyond her mother's death, as she declares losing her father on the same day.

“I lost both my parents that day. My dad died that day, too, because the person who did that to my mom and my father isn’t the same person,” the heartbroken girl said. Olivia, who was at school the day of the shooting, also accused her father of emotionally and financially abusing her and said she would never forgive him for his actions.

Birmingham, sentenced to 10 years in prison, will be eligible for parole in five years.
