CHEYENNE, WYOMING: According to authorities, a 33-year-old from Wyoming allegedly ran over his ex-girlfriend's head with his car because he was upset that she was spreading rumors that made it hard for him to date other women.

The Cheyenne Police Department reports that Cody Fertig is charged with two counts of aggravated assault and one count each of battery, property destruction, and interference with a police officer.

Police questioned victims of hit-and-run incident

The charges are related to a fight that occurred in the early hours of December 10, 2023, at the Maverik Adventure's First Stop gas station on Gardenia Drive in the capital city of the Cowboy State, according to police.

A press release stated that on the day in question, police were called to the gas station at about three in the morning. Two women who related their account of the purported hit-and-run incident were questioned by the police at the scene.

Police reported, "One had been run over by a vehicle and sustained serious injuries; the other had been hit in the face with an ice scraper."

That predawn imbroglio was wild and innuendo-fueled, as an affidavit obtained by Cowboy State Daily recently revealed.

Police claim that Fertig's 23-year-old ex-girlfriend is the main victim. She was leaving a house party that day with a 44-year-old man who would later testify against Fertig, and they were traveling in a 25-year-old woman's Chevrolet Silverado.

What happened at the crime scene?

The witness reported to the police that Fertig's ex-girlfriend was yelling at Fertig on the phone while they were traveling to the gas station. The defendant was there, pacing the parking lot and appearing "agitated," as per the affidavit, when the three people in the truck arrived.

According to the police, Fertig's ex-girlfriend confronted him right away after getting out of the truck.

“One of the females exited the truck carrying an ice scraper and began to argue with Fertig,” police wrote in the press release. “As the argument escalated, he displayed a firearm and pointed it at her. He then took the ice scraper and pushed her to the ground,” the statement further said.

Fertig was charged with pointing the gun but is not said to have fired it, Law&Crime stated. Rather, the accused observed the ice scraper and inquired, "Oh you want to pull a weapon on me?"

He then allegedly took the gun out of his waistband and threw it behind him. He then allegedly attacked his ex-girlfriend, repeatedly punching her in the face and pushing her to the ground.

Additionally, Fertig is accused of repeatedly hitting the truck with the ice scraper, hurling the blunt instrument with a vengeance and slamming it through the driver's side window to strike the 25-year-old woman in the face.

Two somewhat different accounts of what transpired next agree on one extremely graphic accusation.

Cody Fertig arrested after allegedly assaulting his ex-girlfriend

According to the initial police press release, "he went back to the first victim, pushed her to the ground again, and punched her repeatedly before walking back to his vehicle."

"He returned to the first victim, pushed her to the ground again, and punched her repeatedly before walking back to his vehicle. As Fertig was leaving the location, he put his car into reverse, and the front passenger wheel drove over the female’s body and head. He then fled from the scene.”

However, the affidavit that Cowboy State Daily was able to obtain asserts that after the alleged attacker had already gotten into his car, Fertig's ex-girlfriend got up from the ground and ran up to him, citing multiple witnesses and surveillance footage.

The young lady is said to have then yanked open Fertig's passenger door and yelled at him. According to the affidavit, Fertig then turned around and ran over his ex's body and head while using the open door to knock her to the ground.

The woman has miraculously survived. Officer Reece Federer of the Cheyenne Police Department painted a graphic picture of the initial scene: the woman was lying on her back with a pool of blood surrounding her head. Her head appeared swollen and fractured. She also had swollen ankles.

According to the affidavit, the woman was "extremely dazed and confused" and kept repeating herself after getting into the ambulance. The affidavit purports that "after some time, (she) was able to give the first and last name of Cody Fertig."

Following a short foot pursuit, the defendant was taken into custody at an Albertsons grocery store in Cheyenne the following day.

Fertig allegedly expressed his anger towards his ex-girlfriend during his police interview, claiming that the rumor she had spread had prevented him from finding a new girlfriend.

The affidavit states that the defendant admitted to police that "I kind of blacked out a little. I'm not exactly recalling everything."
