'Behavior of a drug addict': Hunter Biden blasted after his team files and withdraws motion for new trial
DOVER, DELAWARE: Hunter Biden's legal team filed and swiftly withdrew a motion for a new trial on Monday, June 17, almost a week after the first son was found guilty of all charges on his purchase of a firearm in 2018.
With two appeals in the case still pending, Biden's legal team, led by lawyer Abbe Lowell, filed a motion on Monday morning in Delaware federal court asking for a new trial, claiming the court lacked jurisdiction.

"The Third Circuit [appeals court], however, did not then and has not yet issued its mandate as to the orders dismissing either appeal," Lowell wrote in the filing, per Fox News. "Thus, when this Court empaneled the jury on June 3, 2024 and proceeded to trial, it was without jurisdiction to do so."
The motion, however, was quickly withdrawn from a court document website.
"The Motion for a New Trial (formerly DI 233) has been deleted at the request of counsel," a note filed on a docket website called it a "correcting entry," the outlet reported.
Hunter Biden was found guilty in gun crime trial last week
Hunter was found guilty last Tuesday, June 11, of making a false statement in the purchase of a gun, making a false statement related to information required to be kept by a federally licensed gun dealer, and possession of a gun by a person who is an unlawful user of or addicted to a controlled substance.
When asked if he was an illegal substance user or addicted to controlled substances in October 2018, he checked the "No" box on a federal firearm form, known as ATF Form 4473.
Prosecutors attempted to show that Hunter lied on the form and he bought the gun from a Wilmington retailer. The first son pleaded not guilty in the case.
Hunter Biden has a well-documented history of drug abuse
Hunter's history of drug abuse is well known. It was primarily chronicled in his 2021 memoir, 'Beautiful Things', which takes readers through his previous obsession with smoking crack cocaine every 20 minutes, how his addiction was so severe that he called himself a "crack daddy" to drug dealers, and anecdotes about drug deals, including one involving a crack dealer in Washington, DC, that Biden dubbed "Bicycles."
Abbe Lowell did not dispute Hunter Biden's long history of substance abuse
Throughout the trial, Lowell did not refute Hunter's extensive history of substance abuse, which includes an alcohol addiction.
Instead, the defense contended, citing the first son's time in rehab before the October 2018 purchase, that he did not view himself as an active drug addict on the day he purchased the Cobra Colt 38.
However, the prosecution claimed that Hunter had a crack cocaine addiction before, during, and following his purchase of the handgun.
Prosecutors revealed to the court that Hunter texted his sister-in-law turned girlfriend, Hallie Biden, just one day after making the gun purchase, stating that he was "waiting for a dealer named Mookie."
He texted her that he was "sleeping on a car smoking crack on 4th Street and Rodney" in Wilmington the day after that previous message.
Hunter Biden will be sentenced later this year
After about two days of deliberations, a jury of his peers found Hunter guilty of all charges. He will be sentenced later this year, though no date has yet been issued.
Hunter faces a maximum prison time of 25 years for the three charges. Each count also carries a maximum fine of $250,000 and three years of supervised release. However, he is a first-time offender, making it unlikely that he will face maximum penalties when he is eventually sentenced.
