NEW YORK CITY, NEW YORK: In a fiery rant on Truth Social, Donald Trump warned that if he loses presidential immunity, President Joe Biden would be stripped of it as well.

What is presidential immunity?

Presidential immunity in the United States allows a sitting president to enjoy absolute immunity from many lawsuits while serving office.

However, the Constitution does not directly discuss the immunity from civil or criminal lawsuits.

David Schultz, a national expert in constitutional law and a professor at the University of Minnesota said, "We have language from some framers indicating that even if there might have been some immunity while a person was president of the United States, once they've left office there's no immunity and they could be charged with the crime," according to ABC News.

Donald Trump claims US is in 'everlasting danger' without presidential immunity

In a Truth Social post, Trump claimed, "Without presidential immunity, it would be impossible for a president to properly function, putting the United States of America in great and everlasting danger!”

Trump claimed that the presidency “will lose its power and prestige, and under some leaders, have no power at all" without immunity.

Why is Donald Trump invoking presidential immunity as a defense?

With the Supreme Court scheduled to hear arguments on presidential immunity, the outcome will determine whether Trump is shielded from prosecution concerning the charges Special Counsel Jack Smith highlighted.

These charges resulted from an investigation into his alleged involvement in election interference.

However, Trump invoked presidential immunity as his defense and pleaded not guilty to the charges.

Donald Trump warns former US presidents

Trump remarked that the "Presidency will be consumed by the other Branches of Government. That is not what our founders wanted!”

"The Opposing Party, during his/her term in Office, can extort and blackmail the President by saying that, ‘if you don’t give us everything we want, we will Indict you for things you did while in Office,’ even if everything done was totally Legal and Appropriate," he stated.

"That would be the end of the Presidency, and our Country, as we know it, and is just one of the many Traps there would be for a President without Presidential Immunity," he added.

“If a President doesn’t have immunity, he/she will be nothing more than a ‘Ceremonial’ President, rarely having the courage to do what has to be done for our Country," he shared.

After Trump warned "crooked" Biden of ending up in "big trouble" if he loses presidential immunity, netizens weighed in on the former president's declarations.

"The problem you refuse to see is that there's never been a President in American history who has needed Presidential immunity. That tells the world a lot about you," a user wrote on X (formerly Twitter).



 

"It's time for accountability to apply to all, not just some. Let's level the playing field and ensure fairness for all," a user opined while another wrote, "Neither one of you has immunity. No one is above the law."
