ATLANTA, GEORGIA: Donald Trump's legal team submitted a motion on Monday, March 18, seeking the dismissal and disqualification of Fulton County District Attorney Fani Willis from the Georgia election interference case.

In the motion, Steve Sadow, the former POTUS' lead attorney in the case, requested the court to promptly remove Willis, as per the New York Post.

This filing comes after Fulton County Superior Judge Scott McAfee ruled on March 15 that Willis could remain on the case, provided that special prosecutor Nathan Wade stepped aside, due to the disclosure of their romantic relationship.

Donald Trump and seven co-defendants in the George election subversion case filed a motion to appeal Judge Scott McAfee's ruling

Requesting to appeal Judge McAfee's ruling, Sadow noted, "President Trump and seven defendants have jointly filed a motion requesting the Court to grant a certificate of immediate review of its order denying dismissal of the case and disqualification of Fulton County DA Willis."

He added, "The motion notes that the Court found that Willis' actions created an appearance of impropriety and an 'odor of mendacity' that lingers in this case, but it nonetheless refused to dismiss the case or disqualify her." 

Rudy Giuliani, Mark Meadows, Robert Cheeley, Michael Roman, David Shafer, Harrison Floyd, and Cathleen Latham were among the seven defendants who joined the motion alongside Trump.

In conclusion, Sadow asserted, "The motion further notes that the Court found Georgia case law lacks controlling precedent for the standard for disqualification of a prosecuting attorney for forensic misconduct. For these reasons among others, the Court’s Order is ripe for pretrial appellate review."

The lawyers submitted their plea following a highly awaited verdict by Judge McAfee of Fulton County Superior Court in the racketeering case.

After the decision was made, both Wade and Willis were presented with a time-sensitive choice. As a result, Wade chose to submit his resignation to Willis, who was able to keep her position for the duration of the case.

The defense counsel, on the other hand, contended that "the resignation of Mr Wade is insufficient to cure the appearance of impropriety the court has determined exits," according to the court filing.

In order for an appeal to take place, Judge McAfee must allow it to be heard, following which the state appeals court must agree to hear it.

Trump attorneys previously filed a motion to remove Fani Willis from the case owing to remarks she made at church

In addition to her relationship with Wade, which has already ended, Sadow and the attorneys condemned Willis' January address at Atlanta's Big Bethel AME Church, in which she claimed the backlash against her and Wade was racially motivated because they are both Black.

The defense attorneys claimed the DA's remarks "crossed the line" and provided compelling evidence that their clients would be "denied the opportunity for a fundamentally fair trial" as long as she was involved. 

"Whether District Attorney Willis and her office are permitted to continue representing the State of Georgia in prosecuting the defendants in this action is of the utmost importance to this case, and ensuring the appellate courts have the opportunity to weigh in on these matters pre-trial is paramount," argued the lawyers.

Notably, Sadow had filed another motion to have Willis removed from the case in January, claiming that her comments at the church were "falsely and intentionally injecting race into this case."

In his decision on March 15, Judge McAfee also criticized the DA for choosing to speak at the church, stating that her remarks were "legally improper" and hinted at the possibility of needing to impose a gag order on her moving forward.

"Providing this type of public comment creates dangerous waters for the District Attorney to wade further into," stated the judge in his verdict.

"love or hate Trump, there's no question of a conflict here... If she really wants the case to go forward, she would have stepped aside especially knowing she was messing around," expressed someone else. 

One more shared, "Fani needs to resign from her job in general. She is supposed to set the example and lied under oath."
