Outrage as judge affirms disqualification of challenger to judge in Trump's GA election meddling case
ATLANTA, GEORGIA: A judge confirmed the disqualification of a candidate who had intended to run against the judge presiding over Donald Trump's 2020 Georgia election meddling case, as reported by the Associated Press.
Tiffani Johnson had submitted her application to challenge the Fulton County Superior Court Judge Scott McAfee, but she was ruled unqualified by an administrative law judge in early April.
She was deemed not qualified after she failed to appear at a hearing on a challenge to her eligibility and Secretary of State Brad Raffensperger affirmed the disqualification.
Last week, Johnson filed a petition requesting a review of the administrative law judge's decision in Fulton County Superior Court.
Robert Patillo is the sole challenger to Judge Scott McAfee's seat
A judge from DeKalb County heard the petition on Thursday, April 25, since all colleagues of McAfee in Fulton County excused themself.
DeKalb Superior Court Judge Stacey Hydrick upheld the administrative law judge's decision to disqualify the challenger, citing her ineligibility.
With Johnson's disqualification, McAfee now has only one challenger for the seat, civil rights attorney Robert Patillo.
However, Johnson's name might not be removed from the ballot due to the early voting, which is set to start on Monday, for the May 21 election.
According to law, a disqualified candidate's name should be withheld or stricken from the ballot. If time does not permit that, authorities should place prominent notices for the voters informing them about the candidate's disqualification.
Johnson's ineligibility was found after a lawyer for Sean Arnold from Fulton County filed a complaint in late March. The complaint pointed out that all judges are required to "reside in the geographical area in which they are elected to serve."
However, Johnson's application said her home address was in DeKalb County and she had been a legal resident of Fulton County for "0 consecutive years."
The paperwork also had her signature on the statement that she was "an elector of the county of my residence eligible to vote in the election in which I am a candidate."
On April 2, Administrative Law Judge Ronit Walker ruled her disqualified after she failed to appear at the hearing, which "rendered her incapable of meeting her burden of proof."
An attorney to the challenger said Johnson did not receive the notice for the hearing.
