MSNOW analyst warns Fauci's Fifth Amendment strategy could shield Trump officials too

WASHINGTON, DC: Anthony Fauci's decision to repeatedly invoke his Fifth Amendment right against self-incrimination during a Senate hearing has sparked debate over its potential implications for future congressional investigations.

Appearing on MSNOW's 'Money, Power Politics with Stephanie Ruhle', Puck News' chief Washington correspondent Leigh Ann Caldwell suggested Fauci's legal strategy could serve as a model for current Trump administration officials if Democrats win back control of Congress.



'Setting the playbook' for future investigations

Caldwell argued that Fauci's testimony demonstrated that receiving a presidential pardon does not exempt someone from being called before Congress.

"He's actually setting the playbook for when Democrats take control of Congress," she said, noting that although former President Joe Biden granted Fauci a preemptive pardon, the former health official still appeared before lawmakers and chose to invoke his constitutional rights rather than answer questions.

According to Caldwell, the same approach could be adopted by pardoned Trump administration officials facing congressional scrutiny in the future.

Pardons do not shield witnesses from Congress

The journalist said President Donald Trump has indicated he intends to pardon officials who could become targets of future investigations.

However, she emphasized that such pardons would not prevent Congress from subpoenaing those individuals to testify.

She argued Fauci's appearance before lawmakers illustrates how witnesses can legally decline to answer potentially incriminating questions despite having received a pardon.

Covid memories and political divisions resurface

Caldwell also said Fauci's testimony revived memories of the Covid-19 pandemic, describing it as a period that deepened public distrust in government and institutions.

She suggested the hearing highlighted the enduring political polarization surrounding the pandemic and its aftermath.

Caldwell noted that Fauci has previously argued his decision to invoke the Fifth Amendment was influenced by concerns that the Trump Justice Department was using investigations for political purposes.



She said Fauci believes the inquiries amount to what Trump himself has often described as a "witch hunt," prompting him to avoid providing testimony that could be used against him.
