“Notwithstanding Plaintiff’s attempts to characterize the Album as a ‘brand,’ the reality is that it is a musical album. It is an expressive work titled The Life of a Showgirl, and is protected by the First Amendment. This protection extends to associated merchandise."
Swift's attorneys also argued that Maren Wade has failed to establish consumer confusion, a key requirement in trademark infringement cases. They further contended that the goods and merchandise sold by the two parties are entirely different, making it unlikely that consumers would mistake one for the other.

The trademark infringement lawsuit was filed on March 30, 2026, by Las Vegas performer Maren Wade, whose professional name is Maren Flagg. She sued Swift over the title of Swift’s October 2025 album, 'The Life of a Showgirl', claiming it is too similar to her trademarked brand, 'Confessions of a Showgirl'.
As per reports, Flagg registered the 'Confessions of a Showgirl' trademark in 2015 and has since used it for her newspaper column, podcast, and cabaret performances.
In her lawsuit, she argued that the two titles are similar enough to confuse consumers because they “share the same structure, the same dominant phrase, and the same overall commercial impression.” She also claimed that both are marketed to similar audiences.
