'That makes sense': Internet backs Jack Smith as Special Counsel urges Supreme Court to deny Donald Trump's request for delay in immunity case

WASHINGTON, DC: Special Counsel Jack Smith urged the Supreme Court to deny Donald Trump's request to delay trial proceedings in the election subversion case as the former president presses for immunity from prosecution, reported CNN.

"The charged crimes strike at the heart of our democracy," the special counsel's team wrote in the briefing filed on Wednesday, February 14.

"A President's alleged criminal scheme to overturn an election and thwart the peaceful transfer of power to his successor should be the last place to recognize a novel form of absolute immunity from federal criminal law," the briefing further read.

The filing was in response to Trump's emergency request to the Supreme Court that he made on February 12 to halt the proceedings so that he could appeal a DC federal court ruling denying him absolute presidential immunity.

The DC Court of Appeals on February 6 unanimously dismissed Trump's claims of immunity to justify his post-2020 election actions as President, emphasizing that he was not above the law.

Jack Smith argues Donald Trump falls short of criteria to challenge lower court ruling

Jack Smith argued that former president Donald Trump did not meet the required criteria to demand the SCOTUS to block the appeals court ruling against his immunity claims.



 

According to an ABC News report, the filing read, "Applicant seeks a stay to prevent proceedings in the district court from moving towards trial, which the district court had scheduled to begin on March 4, 2024, before applicant's interlocutory appeal necessitated postponement of that date. Applicant cannot show, as he must to merit a stay, a fair prospect of success in this Court."

The special counsel also claimed delaying a ruling on the charges would threaten to "frustrate the public interest in a speedy and fair verdict."

Trump's legal team is expected to file a reply, and the court will decide on further proceedings probably within a few days.

The timing of the SCOTUS taking up Trump's request to block the lower court ruling is critical. He could benefit from a delay in the trial until after the November election as he closes in on becoming the GOP presidential nominee.

Netizens agreed with Smith's urgency to speed up the trial, as many are eager to find out if Trump has presidential immunity before heading to the polls in November.
