WASHINGTON, DC: Former White House attorney Ty Cobb has expressed his doubts regarding former President Donald Trump's appeal to the Supreme Court to suspend the ruling rejecting his immunity claim.

Cobb described Trump's argument as "pretty weak" in an interview with CNN's Erin Burnett on Monday, February 12.



 

Recently, an appeals court ruled that Trump could not claim immunity from criminal prosecution in Special Counsel Jack Smith's January 6 case.

The case involves charges related to Trump's alleged efforts to overturn the 2020 election, for which he has denied any wrongdoing.

In a court filing on Monday, February 12, Trump's legal team requested the Supreme Court to halt the lower court's ruling, according to a report by Business Insider.

This would prevent the criminal proceedings from moving forward before an anticipated formal appeal to the Supreme Court in that case.

What did Ty Cobb say during his interview?

Cobb, who served under Donald Trump from 2017 to 2018, called the appeal "pretty weak" and said the argument was "not at all" persuasive.

"It's repetitive of their briefs below," the former White House attorney explained. "The arguments that they presented were not only soundly rejected, but eviscerated both in oral argument and in the opinion. Cobb noted that the Supreme Court has several choices for responding, but he believes they will not hear the case, allowing the lower court's verdict to stand.

The legal argument put forth by the lawyers of former President Trump posits that a president cannot face criminal charges for actions performed in office as part of their duties.

An extreme example cited in support of this position by the former President's legal team is that a president could direct the assassination of a political rival without fear of criminal charges if such an action was not impeached and convicted by Congress.
