LOS ANGELES, CALIFORNIA: Megyn Kelly vehemently criticized President Joe Biden's revision of Title IX regulations, calling it an "abomination" and demanding his removal from office.

On Friday, April 19, the former Fox News host took to X (formerly Twitter) and wrote, "DO NOT EVER LET ANY DEMOCRAT TELL YOU THEY CARE ABOUT WOMEN’S RIGHTS EVER AGAIN IF THEY DO NOT STAND UP TO THIS ABOMINATION OF A TITLE IX REVISION. These regs are a nuclear level attack on women’s rights and men’s due process rights. JOE BIDEN MUST GO."



 

What revisions were brought to Title IX?

The revised rules of Title IX, issued on Friday, extend protection to LGBTQ+ students, a point of contention with Republicans. While the original 1972 law did not explicitly cover this aspect, the updated regulations explicitly state that Title IX prohibits discrimination based on sexual orientation or gender identity.

This means that LGBTQ+ students experiencing discrimination can expect their schools to address the issue under Title IX, and if their schools fail to act, they can turn to the federal government for assistance, as per TIME

Another significant change introduced by the Biden administration to Title IX regulations is the reversal of a provision that mandated in-person hearings for students accused of sexual misconduct.

The new rules still allow for such hearings but no longer require them, while also implementing measures to assess the credibility of involved parties more effectively, as per The New York Times

Ahead of the announcement, Jennifer Klein, the director of the White House Gender Policy Council, said the new rules seek to "restore and strengthen vital protections that were weakened by the prior administration while reaffirming our longstanding commitment to fundamental fairness."

What was the Trump administration's version of Title IX?

The Trump administration's iteration of Title IX was a lengthy and complex document, spanning 2,033 pages, as opposed to previous administrations' versions, such as Obama's 53-page guidance, according to TIME

The complexity of Trump's policy posed challenges for students seeking to understand and exercise their rights under Title IX.

Moreover, under Trump, sexual harassment was redefined and narrowed to actions that are "severe, pervasive, and objectively offensive." With the new rules, the Biden administration broadened the definition, so more complaints may qualify as serious enough to warrant a school investigation. 

As opposed to the previous versions, the updated rules also officially expanded the interpretation of Title IX to include pregnant, gay, and transgender students.

Biden administration's Title IX revision faces backlash

Riley Gaines, host of the 'Gaines for Girls' podcast, and the Independent Women's Forum (IWF) have been vocal opponents of Biden's Title IX revision.

According to Fox News, Gaines argued that the administration's actions undermined decades of progress in women's rights and equal opportunities, particularly in education and athletics. The IWF has condemned the move, stating that it strips away protections for women.

"The president and his administration can't act like they care about women or our opportunities and then go and wipe out women’s protections under the country’s landmark sex equality law," said Gaines in her OutKick podcast. 

She added, "Title IX was passed over fifty years ago to end unjust discrimination in education, including athletics. I experienced this law [being] undermined when female athletes like myself were told to keep quiet when a male swimmer took home a title in the women’s division and deprived female athletes of awards, honors, and the opportunity to compete."

Republican Rep Virginia Foxx, chairwoman of the House Committee on Education and the Workforce, asserted that the updated Title IX "dumps kerosene on the already raging fire that is Democrats' contemptuous culture war that aims to racially redefine sex and gender," as per NPR.

Title IX, initially enacted in 1972, aimed to end discrimination based on sex in education, including ensuring equal opportunities for women in athletics.

However, its implementation and subsequent revisions have sparked ongoing controversy and criticism, especially when it comes to the question of whether transgender students should be entitled to play on school sports teams that correspond to their gender identity.

Internet reacts to Megyn Kelly's remarks about the Biden administration's Title IX revision

One wrote, "Democrats have effectively thrown women under the bus," and another said, "How come we never see a female trans athlete asking to participate in men's sports? We all know the answer. Women are no longer women, they are just birthing people."

A person remarked, "This issue shouldn’t even be an issue. These are common sense items. Purposeful division and hatred. I can’t stomach much more."

Someone else noted, "my daughters played division 1 tennis. So glad they are graduated. This world is nuts," while an individual shared, "Protect women, protect women spaces, protect women’s sports. Title 9 is essential to the protection of women and our well-being. Don’t let men dressed up as women physically harm us."

On the other hand, one questioned, "Particularly can you tell me which revisions you dislike?"

Another person expressed, "So here Republicans are taking away a woman’s right to choose and enacting draconian laws and you’re still bringing up that oh my God transgender folks will use the bathroom they identify with."

They added, "I’m sure you’re the same person that ignores all the Republican predators as well as the predators who are priests, also I don’t hear people like you arguing for more funding for women’s sports whether in high school or college. I guarantee you’re one of those people that also says women in sports should not have pay equal to their male counterparts."
