Eyewitness on Foxx's 'shocking' behavior
Now, following the 2008 incident, which is documented on camera and supported by eyewitness accounts, it certainly adds a challenging dimension for the actor as he endeavors to defend himself.
At a nightclub during this DJ set event, one eyewitness informed DailyMail, “I remember I was pretty shocked when I saw what happened and that's why I filmed it.”
The source added, “I could not believe that he would grab a stranger like that. I don't know who she was. It was not announced that he was performing at the club that night, so I don't know if he just showed up or if it was a secret arrangement.”

According to the outlet, the incident took place at Club Mansion in New York in December 2008, a venue that is no longer operational. Foxx was reportedly clad in black shades and attire while performing on stage.
In the video, the clubgoer starts twerking with him, while he runs his hands up and down her back, buttocks, and thighs.
The witness remembered, "It was on some sort of stage but not set up for a performance. He only performed that one song, 'Blame it on the Alcohol,' which was a big hit back then, and did some DJ-ing."
“I remember a girl who was next to me looking at me in disbelief – like what just happened?” Foxx is not new to performing at nightclubs and has done so for decades.

'Django Unchained' star had denied claims in lawsuit
Foxx's representative vehemently denied the plaintiff's claim in the current lawsuit. The representative stated, "In 2020, this individual filed a nearly identical lawsuit in Brooklyn. That case was dismissed shortly thereafter."
It added, “The claims are no more viable today than they were then. We are confident they will be dismissed again. And once they are, Mr Foxx intends to pursue a claim for malicious prosecution against this person and her attorneys for re-filing this frivolous action.”
Foxx recently rebounded from a harrowing medical emergency, and there were concerns about his ability to make a full recovery.
In an emotional Instagram post, he shared a video providing an update on his health, saying, "I went through something that I thought I would never ever go through."
“I know a lot of people were waiting, you know, wanting to hear updates, but to be honest with you, I just didn't want you to see me ... with tubes running out of me and trying to figure out if I was going to make it through,” he added.
