Nick Carter seeks dismissal of Melissa Schuman's sexual assault case in California, calls them 'false'
SANTA MONICA, CALIFORNIA: Backstreet Boys member Nick Carter has requested the dismissal of singer Melissa Schuman's lawsuit against him in California, accusing her of manipulating the court system during their legal battle.
The lawsuit filed by Schuman alleged that Carter sexually assaulted the singer in his Santa Monica apartment in 2003.
The lawyers for the 'Hurts to Love You' singer further claimed in recent court documents that the case brought by the former Dream band member against Carter should be dismissed since it was filed in the incorrect state, per Patch media.
Nick Carter wants his sexual assault lawsuit dismissed
The claims made in singer-actress Melissa Schuman's case filed in Santa Monica Superior Court include sexual assault, violence, and intentional infliction of emotional distress.
The most recent legal charges against the Backstreet Boys crooner are being made over five years after Schuman initially reported Carter to the Santa Monica Police Department. Schuman named Carter's business, Kaotic Productions, as a defendant as well.
However, the 43-year-old Carter's attorneys contend that though Schuman claims she was assaulted in California, the alleged attack happened more than 20 years ago, and both Schuman and Carter currently reside in Nevada.
The attorneys went on to say that witnesses would find it convenient to go to Nevada even if the assault took place in California.
According to court records obtained by Radar Online, Carter requested that the Los Angeles Superior Court judge dismiss Schuman's lawsuit filed on April 11, 2023.
Melissa Schuman accused Nick Carter of sexual assault
Former Dream member Schuman accused Carter of sexual assault in her April 2023 lawsuit, alleging that the claimed encounter occurred in 2002 at Carter's Santa Monica, California, apartment.
According to the lawsuit, earlier obtained by TMZ, Schuman reportedly begged the Backstreet Boys alum several times, but Carter ignored her, and that was when she had her first sexual encounter. Schuman would have been 18 and Carter 22 at the time.
Schuman claimed that Carter made her have oral sex under duress after she had done the same for him. She reported Carter to the police in 2017 but the District Attorney reportedly opted not to file a complaint.
Schuman's attorneys claimed that in an attempt to refute her allegations against the singer, Carter has repeatedly engaged in "online intimidation" against Schuman.
The complaint alleges that Carter employed his "fan engagement team to encourage (Carter's) dedicated fan base to engage in internet intimidation in an effort to intimidate, blame, harass and discredit plaintiff online."
However, Carter refuted every accusation Schuman made against him.
Attorney Liane Wakayama released a statement stating, "Melissa Schuman has been peddling this tale for many years. But her allegation was false when she first made it back in 2017, and it still is."
Furthermore, in December 2022, Shannon "Shay" Ruth filed a lawsuit in Nevada against Carter, claiming that the singer had sexually molested her on his tour bus during a Backstreet Boys show in Tacoma, Washington, in February 2001.
In response, Carter filed a countersuit in February 2023 for $2.3 million, claiming that Ruth, Schuman, and Schuman's father, Jerome Schuman, had been working together for years to smear and blackmail Carter.
