Sergio Colin-Gomez: California man arrested for shooting girlfriend's 3-year-old son over alleged infidelity

SANTA CLARA, CALIFORNIA: A 24-year-old man in California is accused of killing his girlfriend's 3-year-old son by shooting him in the forehead at close range to kill him in front of her because the victim's mother would not confess to being unfaithful.

Authorities claim that Sergio Colin-Gomez was arrested on February 20 and charged with the murder of young Ivan Martinez-Alvarado shooting a child under the age of eight.

According to Law&Crime, in a statement released on Thursday, February 22, Santa Clara District Attorney Jeff Rosen stated, "We are sickened and heartbroken at the senseless murder of Ivan."

“Nothing we achieve in court, no jury or judge, can make up for the lost life of this innocent child. We will sadly but steadfastly do our job to make sure this person will never harm another.”

A probable cause affidavit from the Santa Clara Police Department states that on February 20, at approximately 2 in the morning, officers responded to a 911 call about gunfire at an apartment complex in the 3700 block of Poinciana Drive, approximately eight miles west of San Jose.

After telling the dispatcher that her "boyfriend shot her baby," the caller—later identified as Ivan's mother—left the house. Gomez was the boyfriend's name, according to the police.

When first responders got to the scene, they saw Gomez strolling along White Oak Lane's sidewalk. He obeyed the officers' orders to stop at first, but after that, he "resisted arrest," until finally being subdued and taken into custody.

When the officers arrived at the apartment, they discovered Ivan lying on his bed with what looked to be a forehead gunshot wound. A handgun was found on the floor of the room, and the man was pronounced dead at the scene, according to the police.

According to the affidavit, the victim's mother—who is currently expecting Gomez's child—told authorities that she and her son were watching television in the victim's room when the young child fell asleep between 10 and 11 p.m.

Gomez entered the mother's room at approximately 11:15 p.m. and said he wished to talk to her "about their relationship."

After having a conversation in the kitchen during which Gomez allegedly accused the victim's mother of cheating on him, they decided to "continue together" and watched a movie in Gomez's room.

Gomez allegedly started "asking (the mother) to answer him yes or no?" approximately an hour into the film. He allegedly told her, "not to be stupid and simply answer yes or no," in response to the mother's claim that she did not understand what he meant, according to police reports. 

“He continued to demand that she answer, ‘Yes or no.’ Fearing for her safety, (the mother) went to (her son’s) room, where he was still asleep on his bed, and locked herself in the room with him,” the affidavit states.

“Gomez then broke through the locked door. Gomez then exited the bedroom and began pacing outside. He soon returned with a firearm, holding it down by his side and yelling, ‘Yes or no!’ The gun suddenly went off and (the mother) looked and saw that (her son) had been shot in the head.”

One more detail regarding the shooting was given in a press release issued by the Santa Clara District Attorney's office. Gomez shot his mother dead when, according to the prosecution, she "reached for the weapon" as he aimed the gun "within a foot of the child."

Gomez is said to have fled the scene on foot after the shooting and run into the responding officers. When Gomez showed up in court on Thursday, the judge ruled that he would be detained without bond.
