Gonzalez claimed that the homeowner left his house after realizing that his grill had been taken and drove his own car to pursue the burglar.
Case to be heard by grand jury
A short distance away, the homeowner pursued the man who was running away with the BBQ pit and confronted two people inside a car.
The man informed the police that he thought the driver of the suspected car might be carrying a weapon. Gonzalez claimed that the homeowner shot the suspect with his own gun out of fear for his own safety.
According to the sheriff, the other occupant of the car was unharmed and is not facing any charges.
The homeowner was taken into custody, and the sheriff stated that he gave a thorough statement about the incident and assisted investigators. Upon completion of the investigation, the case will be turned over to the Harris County District Attorney's Office for a grand jury hearing.
