Aaron Carter's dentist seeks dismissal of wrongful death lawsuit for 'over-prescribing' medication

LOS ANGELES, CALIFORNIA: Aaron Carter's dentist has sought the dismissal of a wrongful death lawsuit filed against him by the late pop star's ex-fiance Melanie Martin on behalf of their 2-year-old son Princeton.

According to court documents obtained by Radar Online, Los Angeles-based dentist Jason Mirabile denied any malpractice claims made in the complaint on behalf of Carter's 2-year-old son.

The lawsuit was brought against the dentist along with a doctor and pharmacy, following the 'I Want Candy' singer's death on November 5, 2022 - with the court filings stating that Carter's death was caused by a "prescription drug overdose".

The Los Angeles County Medical Examiner had earlier ruled that Carter had drowned in his bathtub following the inhalation of compressed air cans and the consumption of Xanax.



 

Jason Mirabile insists late Aaron Carter 'freely and expressly assumed all risks involved'

Dentist Jason Mirabile, who is battling the lawsuit, has refuted any claims that he treated Carter erroneously.

Mirabile contended in his countersuit that Carter ought to have been aware that he "was submitting himself to medical treatment which, because of his existing condition, rendered him susceptible to potential complication or injury, and that by submitting himself to such medical treatment, he freely and expressly assumed all risks involved."

The dentist argued that Prince and Martin have no case because Carter understood all the benefits and drawbacks of every procedure that was recommended for him.

Furthermore, the dentist contended that any damage was the result of superseding and intervening causes as well as outside influences.

Mirabile continued by saying a "reasonably prudent person in plaintiff’s decedent’s position would have undergone the procedure alleged in the Complaint if fully informed."

The dentist, thus, requested that all allegations against him be dropped in court.

Melanie Martin claimed 'prescription drug overdose' as Aaron Carter's death in lawsuit

A cleaner found Carter's deceased body in the bathtub at his California home in November 2022. Later, a representative for the Carter family confirmed his death, expressing shock and sadness over his death.

According to the lawsuit Melanie filed on Princeton's behalf, a "prescription drug overdose" is to blame for the unfortunate death.

The singer inhaled heavily and took a hefty amount of Xanax before drowning in his bathtub, said the Los Angeles County Medical Examiner.

Carter allegedly visited a doctor on June 16, 2020, and was given a prescription for a controlled substance, per Martin's lawsuit on behalf of Prince.

The doctor was charged by the toddler's attorney with neglecting to look up Carter in the database to determine whether he was "obtaining same or similar controlled substances from other sources."

On April 26, 2022, Carter went to the dentist for oral work, as per the lawsuit, which mentioned that he continued for six months.

The dentist was charged in Princeton's lawsuit with "over-prescribing, without medical justification, controlled substances to [Aaron] including, but not limited to Hydrocodone and Oxycodone, as well as Alprazolam."

In its lawsuit, Princeton asserted that there was no "medical justification for the controlled substances prescribed by Defendants and that Defendants were negligent and or/grossly negligent in prescribing controlled substances."

Along with failing to raise any concerns about the kind and quantity of medication that the doctors had prescribed, the complaint also charged the pharmacy where Carter picked up the medicines.

In his lawsuit, Princeton claims to have suffered "loss of love, affection, care" and is seeking unspecified damages.
