Arnold Schwarzenegger seeks lawsuit dismissal as he accuses cyclist of negligence in car crash
LOS ANGELES, CALIFORNIA: Arnold Schwarzenegger is taking a strong stance against a lawsuit filed by cyclist Joanne Flickinger, who claims to have suffered "severe injuries" after an accident involving the actor's car on February 5.
In recent legal documents, the 'Terminator' star denies all allegations of wrongdoing and asserts that Flickinger was "careless," demanding the termination of the lawsuit, according to Radar Online.
Arnold Schwarzenegger blames 'careless' cyclist for car accident, seeks lawsuit termination
According to Flickinger, the actor was operating a motor vehicle on San Vicente Blvd in Hollywood on February 5, 2023.
The negligence of the defendants resulted in their vehicle colliding with [Flickinger], leading to severe injuries," stated the lawsuit.
Flickinger alleged that the actor negligently handled, maintained, repaired, drove, and/or operated their vehicle, ultimately causing the collision and permanent injuries to [Flickinger].
Schwarzenegger contended in his recently submitted response that "[Flickinger] was so careless and negligent regarding the matters outlined in the Complaint that it contributed to some extent to the injuries, damages, and/or losses claimed by [Flickinger]. Therefore, such carelessness and negligence entirely preclude any recovery by [Flickinger]."
Furthermore, he said any injuries she allegedly suffered were caused by third parties outside of his control.
Schwarzenegger asserted, "If found liable to [Flickinger], any such liability should be diminished by the percentage of fault attributed to [Flickinger], as well as all other parties, individuals, firms, corporations, and entities."
He also added, "Moreover, the liability for non-economic damages on the part of these Defendants is separate, not joint, making them responsible solely for the specified amount of non-economic damages."
He demanded that the entire lawsuit be dismissed and that his court costs be awarded.
Arnold Schwarzenegger faced another Lawsuit over car accident
Another woman named Cheryl Augustine sued the actor over a January 2022 accident, alleging that Schwarzenegger drove "wrongfully and recklessly" before colliding with her.
The lawsuit seeks unspecified damages, adding to the legal challenges the 'Terminator' star is currently facing.
Recently, Schwarzenegger and his son settled a $1 million lawsuit stemming from another alleged car crash. As the legal battles intensify, Schwarzenegger finds himself navigating multiple claims and seeking resolution in court.
