NEW YORK CITY, NEW YORK: Ashley St Clair has reportedly filed a lawsuit against Elon Musk demanding sole legal custody of their child.

The writer submitted papers in the New York Supreme Court on Friday, February 21, since she claimed it's the home state of the baby boy, named RSC, as reported by People.

St Clair disclosed on Valentine’s Day that she gave birth to Musk’s 13th child in September 2024, writing, “Five months ago, I welcomed a new baby into the world. Elon Musk is the father.”

In her filing, Ashley St Clair accused the Tesla CEO of being an inactive parent and mentioned that he “has met him only three (3) times and has had no involvement in his care and upbringing".



 

Despite her claim that Musk is the father of the infant, she has still filed a paternity petition along with the child custody petition.

In her documents, the conservative political commentator stated that she and the 53-year-old billionaire started a “romantic relationship in or about May 2023”. They became physically intimate in January 2024 and their child was conceived after that.

Ashley St Clair has also noted that Elon Musk “acknowledged parentage of the child in various written correspondences".

She even asserted that following the birth of RSC, she shared a photo of herself and the baby with him and in response, President Donald Trump's close aide said, “I look forward to seeing you and him this weekend.”

As per St Clair, Musk met RSC on September 21, 2024. The second meeting happened on September 22 and the third and the last meeting was on November 30, 2024, for only half an hour.

Elon Musk allegedly told Ashley St Clair he wants to have more babies with her

The author of ‘Elephants Are Not Birds’ even alleged in her filing that Elon Musk sent her a message in November last year, saying, “I want to knock you up again.”

Another message from him to her read, “Well, we do have a legion of kids to make.”

St Clair’s representative Brian Glickich told People, “Ashley St Clair has filed paternity and custody petitions to protect the best interests of her child. She has made every effort to collaborate with Mr Musk before taking this step.”

Besides, her lawyer Karen B Rosenthal stated in her attorney affirmation, “This firm has been dealing with Respondent’s lawyer and representative, Alyssa Rower from Rower, LLC, in an attempt to resolve this matter privately. The law firm has offices in Manhattan and Westchester, New York."

"However, his representatives have been nonresponsive in the past to resolve the outstanding issues and Respondent has indicated that he no longer wishes to resolve issues of custody and support amicably," Rosenthal added.

Besides his alleged child with St Clair, Musk welcomed six children with his first wife, Justine Wilson, three with his ex-girlfriend Grimes, and three with his Neuralink executive Shivon Zilis.
