LOS ANGELES, CALIFORNIA: Gypsy Rose Blanchard has accelerated the process of divorcing her estranged husband, Ryan Anderson, due to a Louisiana legislation that she believes would make her pregnancy more difficult.

Gypsy, 32, revealed on Tuesday, July 9, that she and her new boyfriend, Ken Urker, who was once her fiance, are expecting their first child together.

Gypsy has been making an effort to move on from her separated husband Ryan, but the law does not currently appear to be on her side. Ken and Gypsy will soon become parents but things got trickier in Louisiana because of a specific statute.

The Louisiana law states: "If the mother is married to someone other than the biological father when the child was conceived or has been divorced for less than 300 days at the time of birth, the husband/ex-husband shall be the presumed father, unless paternity is established for the biological father."

The 'Gypsy Rose: Life After Lockup' star filed for divorce from her husband Ryan in April. The couple were married in 2022, and if the divorce is not finalized by the time the child is born, Ryan might be listed as the father on the birth certificate.

Louisiana attorney Beau Brock talked about the legal issue to People on Friday, July 12.

"There's a legal presumption in Louisiana that if you have a child while you're married, it's presumed to be the husband's child."

"It's done that way to protect the child. All the laws in Louisiana concerning paternity are designed to protect the child and make sure the child has a father and a mother to provide for them," Brock explained.

To comply with this regulation, Ryan must certify in writing that Ken is the father for his name to appear on the birth certificate.

"If the husband goes and signs the affidavit along with the boyfriend, then the true father, if you will, if it's the boyfriend's name, will go on the birth certificate," Brock said.

The courts will order all three of them to submit to a DNA test in order to identify the father if Ryan refuses to comply and Ken wants his name to appear on the birth certificate.

Brock added, "In these kinds of situations, we always recommend to do a DNA test because there are overlapping hookups that are possible. You don't know."

But if Ryan refuses to sign the affidavit or submit to a DNA test to be listed on the birth certificate, "Then the other party [Ken] would hire a lawyer and go in and file for paternity, and then the court would order a DNA test."

"So, in the end, if the boyfriend's fighting it, and the husband will not sign a certificate saying he's the father, ultimately the court's going to make them all take a DNA test," Brock explained.

The birth certificate will be amended to list Ken as the father only when all of these steps have been fulfilled and the DNA results confirm that Ken is the father.

However, Ken's name will appear on the baby's birth certificate without any legal issues if Gypsy and Ryan finalize their divorce before the child is born.

Gypsy and her partner Ken revealed their pregnancy on July 9. Shortly after revealing her pregnancy in a heartfelt video, the 'Gypsy Rose: Life After Lockup' star addressed how it was "wrong timing" for the pregnancy.

Gypsy addresses her ongoing divorce from Ryan and People, "I'm going through a divorce. Timing is not was not where we wanted it to be."

"However, this is a blessing and I take it in stride and move forward with it and I couldn't be happier. It's kind of, like, wrong timing, but it's a blessing. So we're happy," she added.

Gypsy and Ken resumed their relationship after their engagement ended while she was imprisoned for her involvement in her mother Dee Dee Blanchard's murder.

Ken proposed Gypsy in 2018 but their relationship ended years before her 2023 prison release. Gypsy married Ryan during her imprisonment, and the two remained married at the time of her release.
