Eric took to X, formerly Twitter, on Tuesday, December 19. 2023, saying, “Prediction: This Colorado decision will add 5%+ points to @realDonaldTrump already runaway polls.”



 

Despite facing four criminal cases and a civil fraud lawsuit in New York, Trump's lead in the GOP primary polls has remained consistent in recent months.

The 14th Amendment's "insurrection clause" was cited by the 4-3 ruling, which argued that President Trump was engaged in insurrection by promoting false allegations of election fraud and encouraging his supporters to storm the Capitol building.

The Colorado Supreme Court ruled that the office of the presidency falls under the insurrection clause, which applies to individuals who have previously taken oaths to uphold the Constitution as "officer(s) of the United States," "member(s) of Congress," "executive or judicial officer(s) of any State," or "member(s) of any State legislature."

The court has put its ruling on hold until January 4th, allowing Trump to request a review from the US Supreme Court which the Trump campaign spokesperson has already pledged to do.

Until the US Supreme Court resolves the appeal, Trump's name will remain on Colorado's ballot.

Numerous Republican lawmakers have voiced their disagreement with the ruling, with many claiming that it is a partisan attempt by Democrats to prevent President Trump from returning to the White House in 2024.
