Hunter Biden trolled as he seeks to quash gun and tax charges citing Trump's docs case dismissal

WILMINGTON, DELAWARE: Hunter Biden asked to dismiss the criminal cases against him in Delaware and California, citing the dismissal of former President Donald Trump's classified documents case.

Attorneys for President Joe Biden's son argued on Thursday, July 18 filing that Special Counsel David Weiss' appointment in Hunter's gun and tax cases was "unconstitutional."

"Mr Biden brings this motion for lack of jurisdiction to challenge as unconstitutional the appointment and subsequent unlawful funding of these cases," read the filing from attorneys Abbe Lowell and Bartholomew Dalton in Delaware and California federal courts, according to the New York Post.

In June, Hunter was found guilty on all three felony charges in the gun case for purchasing a firearm in 2018 by lying about his drug addiction. The trial on tax charges is scheduled to begin in September.

Hunter Biden attempts to leverage dismissal of Donald Trump's classified docs case

Earlier this week, US District Judge Aileen Cannon dismissed all charges against Donald Trump's classified documents case in Florida, claiming special counsel Jack Smith was unconstitutionally appointed.

Attorney General Merrick Garland appointed him in 2022 to lead two probes against the former president, but the Senate did not confirm his appointment.

Cannon's move was inspired by the questions Supreme Court Justice Clarence Thomas posed in the presidential immunity ruling.

The conservative justice challenged the legitimacy of Smith's appointment in a concurring opinion after the top court ruled in favor of Trump, granting him immunity for his official acts. The special counsel's appointments broke "constitutional structure," according to Thomas.

"Based on these new legal developments, Mr. Biden moves to dismiss the indictment because the Special Counsel who initiated this prosecution was appointed in violation of the Appointments Clause as well," Hunter's lawyers said as per Fox News. "The Attorney General relied upon the same authority to appoint the Special Counsel in both the Trump and Biden matters, and both appointments are invalid for the same reason."

However, the argument put forth by Hunter's lawyers could not be weighed on the same scale because, unlike Smith, Weiss' role as a US attorney in Delaware was confirmed by the Senate.

Recently, President Biden also criticized Cannon's decision to toss Trump's classified documents case, considering  the "basis upon which the case was thrown out" was "specious."

The sentencing date for Hunter's gun trial, where he could face up to 25 years of imprisonment, has not been scheduled yet.

Internet mocks Hunter Biden for attempting to toss criminal cases against him

Hunter Biden faced online mockery for filing a motion to use the dismissal of Trump's classified documents case to dismiss his own gun and tax cases.

Netizens quipped about his alleged presidential immunity and speculated that he was worried about his father potentially ending his reelection bid.

"Tax cheats deserve prison Imagine going to bat for hunter Biden. What a clown," a user wrote. [sic]

"Because he has presidential immunity too?" Asked another.



 



 

"Well, the Big Guy is stepping down and old Hunter is on his own," added a user, referring to speculation about Biden dropping down from the race.

"So when did Hunter Biden serve as POTUS?" Read a response.

"He’s worried if dad drops out of the race he won’t be there to pardon him," another person wrote.



 



 



 

"So NO. Swing and a Miss, Hunter. 'In the Hunter Biden case, circumstances are different because Weiss was Senate confirmed as U.S. attorney in Delaware,'" someone else remarked.

"So he admitted to acting as president of the United States? lol," an individual added.

"His lawyers dont know the difference ? lol,they vare getting worried his father wont be able to pardon him and are getting desperate," another user said. [sic]
