Legal analyst Gregg Jarrett accuses Joe Biden of 'defying the law' with new student loan forgiveness plan on 'Fox & Friends'

NEW YORK CITY, NEW YORK: Co-host Lawrence Jones was joined by Fox News legal analyst Gregg Jarrett to discuss the new student loan debt forgiveness program announced by President Joe Biden on Monday, April 8 episode of 'Fox & Friends.'

While administrative officials stated that the new plan has been designed not to violate any principles laid out by the US Supreme Court justices, Jarrett still believes it to be unconstitutional, claiming that it will transfer billions of dollars in debt to taxpayers.

Joe Biden's new student loan debt bailout program

According to The New York Times, Biden's proposed program seeks to reduce the debt of 25 million borrowers on their undergraduate and graduate loans and do away with the entire amount for more than 4 million. Collectively, 10 million borrowers would see debt relief of $5,000 or more, shared White House officials.

Addressing a small gathering in Madison, Wisconsin, Biden said, "While a college degree still is a ticket to the middle class, that ticket is becoming much too expensive. Today, too many Americans, especially young people, are saddled with too much debt.”

He claimed that the effort would help the economy by removing the drag of enormous debt from people who would otherwise not be able to buy a home or pursue a more economically sound future, stating, "We’re giving people a chance to make it. Not a guarantee. Just a chance to make it.”

The approach targets 5 groups of borrowers instead of sweeping across the board. They include those whose loans ballooned because of interest, borrowers paying back for decades, those with economic hardship, those who have not applied for existing programs but qualify for the same, and people whose loans come from schools that have since been denied certification or have lost eligibility for federal student aid programs.

"They're inventing a different, runaround, the Supreme Court decision," Jarrett said on the show, referring to Biden's original 2022 plan to wipe out $400 billion in student loan debt being blocked by SCOTUS.

"In so doing, Joe Biden is brazenly defying the law, and then he has the audacity, the arrogance to brag about it, admitting recently, yes, the Supreme Court blocked my plan, it's illegal. But then he said, quote, that won't stop me."



 

"You know, no amount of lawlessness is beyond Joe Biden by dictate," he continued. "What he's really doing is shredding the Constitution. He changed his method of loan forgiveness in the latest plan. But the same legal principles that make it unconstitutional, still apply."

"He's not canceling anything, he's transferring billions of debt from borrowers to taxpayers, and under the Constitution, only Congress has the power to do that, as the Supreme Court explained in their decision. So this is a stunning act of contempt," added Jarrett.

He continued, "Biden says he doesn't care about the separation of powers, the law, or the Constitution. So I sort of ask you here: who's the dictator? Who's the threat to democracy?"
