NEW YORK CITY, NEW YORK: Hollywood actress Lindsay Lohan's mother Dina Lohan has claimed that she suffered 'serious and permanent personal injuries' as a result of a collision with a truck over two years ago.

The 61-year-old American TV personality filed a civil complaint against Penske Truck Leasing Co. in the New York Supreme Court on February 27, alleging that a driver using a business vehicle collided with her car on April 22, 2022.

In the civil complaint filed in the New York Supreme Court, Dina claims, per documents obtained by Daily Mail, that she "suffered incurred medical and other expenses as a result of her injuries" and is requesting an undisclosed sum of money.

The 'Living Lohan' star—whose daughter recently gave birth to her first child—claims that when the collision occurred, the driver was traveling at an "excessive rate of speed and/or at a greater rate of speed than care and caution would permit under the circumstances."

The lawsuit reads: "The Plaintiff became sick, sore, lame, and disabled and so remained and suffered pain and damage to their physical and mental health, all with conscious pain and suffering incurred medical and other expenses as a result of her injuries."

The claim accuses the driver of "negligently, recklessly and carelessly failing and omitting to provide and/or make proper and timely use of braking mechanisms, signal devices and steering devices."

According to the celebrity's legal representatives, the incident occurred because the driver failed to "observe and obey traffic control devices and traffic signal controls," as well as to "look in the direction in which the vehicle was traveling."

The driving company's 2016 Freightliner collided with the "rear and passenger side" of a 2008 Chevrolet at around 10 am in New York's Murray Hill neighborhood, per the lawsuit.

The action further states: "By reason of the foregoing, the Plaintiff is entitled to recover for non-economic loss and for such economic loss as is not included within the definition of basic economic loss as set forth in Section 5102(a) of the Insurance Law of the State of New York."

"As a result of the foregoing, the Plaintiff has sustained serious injuries as that term is defined in Section 5102(d) of the Insurance Law of the State of New York."

Dina Lohan received 18 days jail sentence for a 2020 hit-and-run incident

The lawsuit comes years after Dina was sentenced to 18 days in jail for a drunken hit-and-run collision at a Long Island steakhouse in 2020.

Dina smashed her Mercedes into a Honda in the Outback Steakhouse parking lot in Merrick, Long Island, in January 2020. She was sentenced in Nassau County Court in Mineola, Long Island, after accepting a plea deal, per Daily Mail.

She then attempted to flee the scene but was pursued by the Honda driver. Police said Dina was found in the driver's seat of her vehicle outside her home but Lindsay was not there.

Dina was arrested after allegedly refusing to undergo a breathalyzer test and cursing at officers. The arresting officer observed that her breath smelled of alcohol and her eyes were "glassy and bloodshot."

Dina's arrest for DWI in January 2020 marks her second offense. She was arrested in 2013 for drunk driving when police stopped her for going 77 mph in a 55 mph zone. Her blood alcohol concentration at the time was more than double the legal limit, per the outlet.
