MANHATTAN, NEW YORK: A recent appeal by lawyers representing former President Donald Trump in the ongoing Stormy Daniels hush money criminal case was rejected by a judge in a New York appeals court.

This was the latest in a series of attempts by Trump's legal team to delay the trial, which is scheduled to begin jury selection in Manhattan on Monday, April 15.

The filings submitted by Trump’s legal team called for Judge Juan Merchan's recusal deemed a gag order as a violation of constitutional rights, and also claimed presidential immunity, according to a report by DailyMail.

Despite their efforts, the judge denied their motion to pause the case while they challenged Judge Merchan's verdict, marking the third instance in three days that Justice Ellen Gesmer ruled against Trump's legal team.

What did Trump’s lawyers contend at Wednesday’s hearing?

Former President Trump’s lawyer Emil Bove said at the emergency hearing, “We´re here for this stay because there are restrictions in place that cannot operate in a constitutional way in a trial environment.”

“It's an incredibly important trial. It's a historic, unprecedented proceeding,” Bove argued. “This can only be done once and it must be done right.”

Bove sought to persuade the judge that Merchan had "exceeded his authority" and expressed concerns that crucial evidence might be omitted.

Steven Wu, an attorney representing Manhattan District Attorney Alvin Bragg's office, contended that the delays would be detrimental to the state.

“Staying the trial at this point would be incredibly disruptive,” Wu claimed. “The court, the people, and witnesses have made extraordinary efforts to make sure this trial can take place on Monday.”

The upcoming trial regarding hush money payments made by former President Donald Trump is set to commence on Monday, with jury selection being the first order of business.

However, Trump's legal team made a last-ditch attempt to delay the trial by filing yet another appeal, which is the latest in a series of efforts to postpone the trial. New York appeals courts have already rejected two previous attempts to delay the case.

The most recent filing is a petition against Judge Juan Merchan, in which Trump's lawyers challenge his decision not to recuse himself from the case, as well as his refusal to hear arguments about presidential immunity.

The former POTUS has pleaded not guilty to 34 counts related to falsifying business records in connection with a $130,000 payment to adult film actress Stormy Daniels during his 2016 election campaign.

This case may be the only one of Donald Trump's four criminal trials to be completed before November's presidential election. As a result, his legal team has intensified its efforts in recent weeks to delay or derail the case.

The trial may feature blockbuster testimony from witnesses such as porn star Stormy Daniels, and Trump's former fixer, Michael Cohen.

Nevertheless, the case is scheduled to proceed as planned, pending the outcome of Trump's latest appeal. The timing of the latest petition's hearing remains uncertain, as there was no immediate indication provided on Wednesday.

The petition is centered around the issue of presidential immunity. Justice Merchan, who is involved in the case, has previously stated that Trump did not bring up this claim in a timely manner.

“This court finds that defendant had myriad opportunities to raise the claim of presidential immunity well before March 7, 2024,” Judge Merchan wrote earlier this month.

According to legal scholars, the case against Trump in New York appears to be weaker than others. However, a recent poll shows that a significant majority of voters view the accusations as serious.

Approximately two-thirds of registered voters stated that the charges are at least "somewhat serious," while only 34% of respondents in the Reuters/Ipsos survey believed the allegations lacked seriousness.
