'Unconstitutional': White House outraged as SCOTUS allows Texas to arrest migrants under SB4 immigration law amid pending appeal

WASHINGTON, DC: The Supreme Court permitted Texas officials to jail and prosecute migrants suspected of entering the US illegally on Tuesday, March 19.

With this decision, the controversial state immigration law, SB4, came into effect, while the US Court of Appeals for the 5th Circuit weighed its legality. 

SB4, which was passed by the state's legislature in 2023, is claimed to be unconstitutional by the federal administration.

According to CBS News, the law criminalizes unauthorized migration at the state level, making the act of entering the country outside of a port of entry, which is already a federal offense, into a state crime. It also establishes a state felony charge for illegal reentry.

Sonia Sotomayor, Elena Kagan, and Ketanji Brown Jackson, SCOTUS' three liberal justices, disagreed with the majority ruling.

Justice Sotomayor remarked that it "will upend the longstanding federal-state balance of power and sow chaos" and "disrupt sensitive foreign relations," as per BBC

White House 'fundamentally disagrees' with the Supreme Court ruling

The official statement from White House Press Secretary Karine Jean-Pierre read, "We fundamentally disagree with the Supreme Court’s order allowing Texas’ harmful and unconstitutional law to go into effect."

It added, "SB4 will not only make communities in Texas less safe, it will also burden law enforcement, and sow chaos and confusion at our southern border. SB4 is just another example of Republican officials politicizing the border while blocking real solutions."

"We remained focused on delivering the significant policy changes and resources we need to secure the border – that is why we continue to call on Congressional Republicans to pass the bipartisan border security agreement, the toughest and fairest set of border reforms in decades," concluded the stern statement.

One wrote, "Is anyone else tired of this like I am? The Supreme court made the right decision. I stand with Texas and secure borders," and another said, "Biden is pissed because he needs those illegals to be his voters."

A person remarked, "I thought he said he wanted something done about the border? You’d think he’d be happy about this? Unless he lied and really wants it left open, surely that couldn’t be the case? Of course it is silly me."

Someone else expressed, "So the federal government doesn’t want our borders secure! And they don’t want anyone else doing it! Does everyone get it yet?"
