'He is nothing but a fraud': Internet slams Trump for demanding new E Jean Carroll trial citing 'restrictions' on his testimony

MANHATTAN, NEW YORK: Donald Trump requested a fresh trial after he was ordered to pay $83.3 million in E Jean Carroll's defamation lawsuit. 

US District Judge Lewis Kaplan has already dismissed many of the arguments made in the ex-POTUS' two separate post-trial motions filed on Tuesday, March 5, as reported by The Hill.

In the filings, Trump specifically criticized Kaplan, a Clinton-appointed judge, for imposing extensive restrictions on what he could tell the jurors during his testimony.

Kaplan imposed the restrictions after finding Trump guilty of defamation because of the columnist's win in a separate lawsuit in 2023 and limited January's trial to evaluating damages.

Trump's legal counsel cited an exchange before the ex-POTUS' scheduled hearing in which the judge stated that he wanted to know "everything (Trump) is going to say."

Kaplan had meticulously reviewed each question and Trump's intended responses before his testimony in front of the jurors began. During his testimony, the former president was cut off by Kaplan at times, with the entire process lasting less than five minutes.

Trump attorneys Alina Habba and John Sauer mentioned in Tuesday’s filing, "Just before President Trump took the stand at trial, the Court engaged in a colloquy with defense counsel designed to restrict the scope of President Trump’s testimony."

According to their argument, the exchange in question unfairly restricted the extent to which Trump could testify, preventing him from discussing his mental state with regard to Carroll.

When the ex-POTUS took the stand, he was only asked two questions, one of which was even objected to, as they noted.

"Did you ever instruct anyone to hurt Ms Carroll in your statements," Habba asked Trump during the trial earlier this year to which the 77-year-old MAGA strongman replied, "No," before adding, "I just wanted to defend myself, my family, and frankly, the presidency."

Carroll's lawyer raised an objection, which the judge upheld, instructing the jury to reject Trump's statements beyond "no."

Donald Trump is due to pay $547 million in penalties

Trump's lawyers had previously protested the restrictions but were unsuccessful, so they are now asking for a new trial, requesting the judge to cut the $83.3 million penalty. 

The former president earlier requested that the judge postpone enforcement of the $83.3 million judgment, or at least allow for a reduced bond amount, in preparation for his post-trial defenses, claiming that they would attempt to get the amount completely thrown out or significantly reduced.

Under the default procedures of the federal courts, efforts to collect the amount for the damages incurred from Trump might begin as early as next week. Carroll opposes Trump's plea for another postponement.

The judge wrote in a brief order on Monday, "A decision will be rendered as promptly as is reasonably possible. Without implying what that decision will be or when it will be made, however, it will not come today."

Trump's request for a delay comes in the aftermath of a significant penalty of over $454 million, accompanied by interest, in his New York civil fraud case. As per reports, the daily interest on the civil fraud trial judgment amounts to an increase of over $111,000, and each day it goes unpaid, the interest accrues.

The presiding judge in the matter determined that Trump and other senior executives at the Trump Organization were culpable of fraud and had conspired to manipulate the former president's net worth for tax and insurance benefits.

Several estimates, including those by Forbes and Bloomberg, have guessed Trump's net worth between $2.6 billion and $3.1 billion.

However, it is uncertain whether the former president has sufficient liquid assets to pay the entire amount.

The GOP presidential frontrunner recently informed a New York court that it would be "impossible" to obtain a bond for the "exorbitant and punitive" amount of the fraud verdict while he files an appeal.

Between the fraud judgment and the verdict in Carroll's case, Trump must pay a total of $547 million to continue his appeals of the cases, although this amount continues to increase with each passing day.
