LOS ANGELES, CALIFORNIA: Sean ‘Diddy’ Combs is drawing comparisons between himself and President-elect Donald Trump in a bid to secure bail over Thanksgiving.

Diddy is currently in prison after getting arrested in mid-September. The 55-year-old music mogul is awaiting trial on May 5, 2025, for his three-count indictment on racketeering conspiracy and sex trafficking.

However, the embattled rapper’s legal counsel has tried getting him bail since Diddy was arrested. In the latest bid to get the Bad Boy Records founder out for Thanksgiving, Diddy’s legal team is now using the ‘Donald Trump’ defense, reports Daily Beast.

In a letter addressed to Judge Arun Subramanian on Friday, November 22, Sean 'Diddy' Combs’ lawyers compared Trump’s federal criminal case and Diddy’s situation in their bid to request bail for the rapper. 

Diddy’s legal team argued that the First Amendment protects the rapper’s statements on social media and other public venues while adding his speeches should be evaluated based on the “most demanding scrutiny” as it was in Trump’s presidential immunity case. 

His attorneys wrote, “The Court should apply Trump’s heightened standard when considering Mr Combs’ speech here.”

As the attorneys tried to bail Diddy out, the prosecutors claimed that the ‘Last Night’ singer was trying to influence the jurors from behind the bars. Citing Trump’s defense, they argued that Diddy reserves the right to “criticize and speak out against the prosecution and the criminal trial process that seek to take away his liberty.”

During Trump’s trial regarding his alleged attempts to overturn the 2020 election, the former president regularly shared his thoughts on social media, leading many to question whether those comments hampered the path to justice. 

Trump’s team, however, argued that “only a significant and imminent threat to the administration of criminal justice will support restricting Mr Trump’s speech.”

Diddy’s lawyers, thus argued that for a similar reason, he has a “greater constitutional claim” than other trial participants to criticize the prosecution and speak out publicly.

The latest proceeding in Sean 'Diddy' Combs' case happened as his lawyers referred to a social media post by his children wishing him a happy birthday.

“The government’s arguments that asking his children to post birthday wishes on Instagram and that he is not entitled to publicly express his opinion that this prosecution is racially motivated are, quite simply, an unconstitutional effort to silence him,” wrote the former mogul’s attorneys, as reported by NewsNation.

The federal prosecutors fired back with their argument, writing, “Defendant’s intent could not be clearer: he expressly wanted to interfere with the jury pool in this case through a targeted, public, social media post, and he caused his family members to make the post.”

While Diddy is awaiting his May 5 trial, the ‘Coming Home’ singer attended a pretrial hearing on Friday, November 22.
