WILMINGTON, DELAWARE: In a long-awaited release, the Department of Justice unveiled its investigation into President Joe Biden's handling of classified documents on Thursday, February 8, offering a scathing assessment of his "diminished faculties" and lapses in memory.

While the report stopped short of recommending charges against the 81-year-old president, it painted a troubling picture of files discovered in Biden's garage and raised serious concerns about his fitness for office.

Memory Lapses and National Security Risks

During interviews with investigators, Biden exhibited confusion regarding key dates from his tenure as vice president, even struggling to recall the year his son Beau passed away.

Additionally, the report highlighted Biden's casual approach to classified materials, including his habit of sharing sensitive documents with a ghostwriter, posing a significant national security risk.

One of the factors cited for the decision not to pursue charges was the belief that Biden's "diminished faculties in advancing age" would elicit sympathy from jurors, potentially clouding the legal proceedings.

"At trial, Mr Biden would likely present himself to a jury, as he did during our interview of him, as a sympathetic, well-meaning, elderly man with a poor memory," they wrote.

This contrasts sharply with the case of former President Donald Trump, who faced charges for illegally retaining classified documents at his Mar-a-Lago estate.



 

Special Counsel Robert Hur's year-long investigation is expected to undercut Biden's campaign rhetoric targeting Trump's alleged transgressions, providing ample ammunition for Trump's supporters.

The report details Biden's inability to recall crucial dates and events, including discussions surrounding the withdrawal of troops from Afghanistan early in his presidency.

"He did not remember when he was vice president, forgetting on the first day of the interview when his term ended ('If it was 2013 - when did I stop being Vice President?'), and forgetting on the second day of the interview when his term began ('in 2009, am I still Vice President?')," the report stated. "He did not remember, even within several years, when his son Beau died."

Photographs included in the report depict classified documents stored alongside household items in Biden's Delaware home, raising further questions about his handling of sensitive information.

"We also expect many jurors to be struck by the place where the Afghanistan documents were ultimately found in Mr Biden's Delaware home: in a badly damaged box in the garage, near a collapsed dog crate, a dog bed, a Zappos box, an empty bucket, a broken lamp wrapped with duct tape, potting soil, and synthetic firewood," the report adds. 

Notebooks containing classified intelligence were found in unlocked drawers, with Biden reportedly consulting them extensively during discussions with his ghostwriter for his 2017 memoir, 'Promise Me, Dad.'

Joe Biden's Unabashed Response

Despite the damning findings, Biden expressed relief that no charges would be filed, declaring the matter closed. 

"I cooperated completely, threw up no roadblocks, and sought no delays," he reportedly said. "In fact, I was so determined to give the special counsel what they needed that I went forward with five hours of in-person interviews over two days on October 8th and 9th of last year, even though Israel had just been attacked on October 7th and I was in the middle of handling an international crisis."

White House spokesman Ian Sams denounced the report's criticism of the president's memory as inaccurate and unwarranted. "The inappropriate criticisms of the president’s memory are inaccurate, gratuitous, and wrong," he said. "We told the Special Counsel this."

Meanwhile, Trump seized on the report as evidence of a double standard in the justice system, arguing that Biden's actions were more egregious than his own.

"The Biden Documents Case is 100 times different and more severe than mine," he said in a statement. "I did nothing wrong, and I cooperated far more. What Biden did is outrageously criminal - He had 50 years of documents, 50 times more than I had, and 'WILLFULLY RETAINED' them."

Hur's investigation, distinct from a separate probe into Trump's post-presidential conduct led by Special Counsel Jack Smith, concluded that Biden could not be prosecuted while in office, the New York Post reported.

Critics, however, raised concerns about Biden's fitness for leadership, arguing that if he is too senile to stand trial, he is unfit to serve as president. "If you're too senile to stand trial, then you're too senile to be president," Alex Pfeiffer, of the Trump-supporting PAC Make America Great Again, contended. "Joe Biden is unfit to lead this nation."

Social Media Uproar

The release of the report sparked widespread reactions on social media.

"Where’s the 'it’s just a stutter' crowd now?" one posted on X.

"So, now he's decrepit enough to escape the mens rea of a criminal charge, but still compos mentis enough to be a viable candidate for 2024? I see a change brewing," another offered.

"Here it comes… this is where the DNC nominates either Michelle Obama or Newsom, and using this as their reasoning," someone else wrote.
