LOS ANGELES, CALIFORNIA: Cher has again reportedly faced a loss over her conservatorship plea for her son Elijah Blue Allman.

The singer wanted to become a temporary conservator for Elijah, claiming he suffers from mental health problems and substance abuse.

But on Monday, January 29, Judge Jessica A Uzcategui threw out her request of temporary emergency conservatorship, citing “no urgency”, the Daily Mail reported.

Cher fears son Elijah Blue Allman won’t live longer

The Los Angeles Superior Court judge reportedly also said that she did not find any “lack of capacity” in the 47-year-old musician.

The ruling came after Cher in her argument earlier told the court that “she feared that her son would not be alive within the year.”

The ‘Strong Enough’ singer’s lawyers said, as per PEOPLE, “Cher was told by doctors that if she did not take this step as his mother that he will once again end up on the street.”

But Judge Uzcategui stated, “I don’t question Cher’s concerns being driven by concern for her son. I don't think [Allman] questions that,” before adding, “I have not seen the evidence to grant a temporary, emergency conservatorship as of today.”

Elijah Blue Allman expressed his happiness after the ruling

After the decision, Elijah's attorney Steven Bremer told the publication, “Elijah is thrilled, as the Court saw, he does not need a temporary conservatorship.”

He continued, “He's grateful to his fans, friends, and community for their support. He's doing great.”

“We're looking forward to March. He's doing great. He's here today,” Bremer added while referring to a March 6 hearing for a long-term conservatorship.

Court rejected Cher's petition for the second time

This was the second time when Cher’s petition was declined by the court.

Earlier in January, Judge Uzcategui rejected her motion, which reportedly claimed, “Elijah is substantially unable to manage his financial resources due to severe mental health and substance abuse issues.”

The 77-year-old actress further mentioned, “Elijah is entitled to regular distributions from a trust established by his father for his benefit, but given his ongoing mental health and substance abuse issues, Petitioner is concerned that any funds distributed to Elijah will immediately be spent on drugs, leaving Elijah with no assets to provide for himself, and putting Elijah’s life at risk.”

Cher also blamed Elijah’s wife Marieangela 'Queeny' King and added that she “is not supportive of Elijah’s recovery and that Angela actively works to keep Elijah from getting clean and sober or receiving mental health treatment that he desperately needs.”
